AMENDING THE: [)E:VEi_,JPMENT ',ERVICES BUILDING DIVISION FEE
SCHEDULE AND RESCINDING ORDINANCE NO 638
WHEREAS, the City of Poway provides Building Permit services to the
citizens of Poway; and
WHEREAS, the processing of such permits requires staff time to
investigate the circumstances surrounding the application and perform other
related tasks, and
WHEREAS, California Government Code Section 66016, et seq.,
establishes procedures for the adoption of fees for services provided by local
government; and
WHEREAS, the last comprehensive revision to the permit fee schedule for
building services was approved by the City Council on July 18, 2006, by
Ordinance No 638, and
WHEREAS, a comprehensive review of the City's fees for building
services has been conducted, and
WHEREAS, as a part of the review ofthe City's fees for building services,
the City has considered information provided by the City's building services
contractor, the Esgil Corporation, which supports an increase in the fees for
building services due to inflation, and the implementation of new State building
codes that have caused an increase in workload; and
WHEREAS, Esgil Corporation has also proposed a minor revision to the
methodology used to calculate Plumbing, Mechanical and Electrical fees, which
would calculate those fees based on a percentage of the building permit fee,
rather than the number of fixtures, to streamline the plan check process, and
WHEREAS, the proposed fee adjustments are necessary to allow Esgil to
continue to provide its current level of service to the City; and
WHEREAS, the proposed fees do not exceed the reasonable costs of
providing the services for which the fees are imposed; and
WHEREAS, the proposed fees will supersede any previously established
fee for the specifi~d City services, and

WHEREAS, The revised fee schedule contained in Exhibit A shall not
apply to any project for which a substantially completed application, as
determined by the Director of Development Services, for Building Permit,
Development Review, Conditional Use Permit, Minor Conditional Use Permit,
Variance or Minor Development Review application has been submitted prior to
the effective date of this Resolution However, if the applicant does not obtain
approval of the application within one year of submittal, or if the approval of the
application expires and no Building Permit is obtained prior to its expiration, then
any re-submittal of the application or submittal of a new application would be
subject to the Building Permit fees in effect at the time of Building Permit
application.
WHEREAS, a duly noticed public hearing has been held, allowing
for public comment on the establishment of said fees
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Poway as follows
Section 1. The foregoing recitals are true and correct, and the City
Council so finds and determines.
Section 2. That the fees shown in the attached Master Fee Schedule
for 2009 for the Development Services Building Division, which is Exhibit A to this
Resolution, and the Valuation Schedule which is Exhibit B to this Resolution, are
hereby adopted, and supersede any previously established fees for the identified
City services
Section 3. The fees shown in the attached Master Fee Schedule
(Exhibit A) for 2009 for the Development Services Building Division, and
Valuation Schedule, shall become effective February 2, 2009

Expedited processing is only available for unusual circumstances as deemed appropriate by City Staff. Charges for
expedited services shall be determined by using an hourly rate of two times the current preferred hourly rate as
established by EsGil Corporation.
Projects requiring additional inspections, additional re-inspection or additional plan check of revised plans shall be
determined using the current preferred hourly rate established by EsGil Corporation (one-hour minimum).
