CC 2000 10-03CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING OCTOBER 3, 2000 The October 3, 2000, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Cafagna at the City Council Chambers, 13325 Civic Center Drive, Poway, California. (401-10) Approval of Minutes - City Council September 12, 2000 - Regular Meeting September 14, 2000 - Adjourned Regular Meeting Adoption of Resolution No. 00-093 - Ordering Summary Vacation of a portion of Old Coach Road Right-of-Way within Parcel 2 of Parcel Map No. 17989, Parcel "C" of Boundary Adjustment No. BA 94-08 and Lot "A" of City of Poway Tract No. 89- 13R, Map No. 13339 (Vacation 00-04). (1002-06) 10. Appropriation of Lighting District Funds for the Conversion of Incandescent Green Signals to Light-Emitting Diodes (LED) and Adoption of Resolution No. 00-094 Approving the Execution of SDG&E's Commercial/Industrial Incentive Agreement. (602-01 #1438) Motion carried unanimouslly. ITEM I (701-04) ORDINANCE NO. 530/FIRST READING REGULATING ROLLER DEVISES Mayor Cafagna opened the public hearing and read the title of Ordinance No. 530, "An Ordinance of the City of Poway, California, Adding Chapter 10.60 to the Poway Municipal Code Regulating Roller Devices." Staff report by City Manager Bowersox. This is the second reading of a City ordinance regulating roller devices. Motion by Councilmember Goldby, seconded by Councilmember Emery, to close the public hearing, waive further reading and adopt Ordinance No. 530. Motion carried unanimously (roll call vote). ITEM 2 (203-13/203-08/203-04) ENVIRONMENTAL ASSESSMENT CONDITIONAL USE PERMIT 00-13 DEVELOPMENT REVIEW 00-10 VARIANCE 00-09 APPLICANT: BOUKATHER AND ASSOCIATES Mayor Cafagna opened the public hearing. Introduction by City Manager Bowersox. This is a request to construct a 16,751 square foot auto collision repair facility on a 1.1-acre site located on the northeast corner of Poway Road and Olive Tree Lane. This item was continued from the September 19, 2000 meeting to permit the applicant time to clarify several design issues. Development Services Director Fritz provided a brief overview of the report. Motion by Councilmember Goldby, seconded by Councilmember Emery, to close the public hearing and deny the application without prejudice. Motion carried 3-2 with Councilmember Rexford and Mayor Cafagna voting no. ITEM 2.1 (203-01) ENVIRONMENTAL ASSESSMENT TENTATIVE TRACT MAP 99-01R APPLICANT: ROBERT LAMAGNO, LOUISE KRONUS, JAMES & KATHRYN KENT Mayor Cafagna opened the public hearing. Introduction by City Manager Bowersox. Staff report by Development Services Director Fritz. This is a request to subdivide a 6.69 acre property into 14 residential lots on the east side of the 14440 block of Midland Road, south of Outlook Road and north of Norwalk Street. The item was continued from the August 15, 2000 meeting to August 29th and from the August 29th meeting to this evening to allow the applicant to provide alternative designs as suggested by the Council. The following people were present wishing to speak: Dee Fleischman, 15070 Pomerado Road, expressed her views on the project design. Leela Bingham, 13619 Somerset Road, spoke in support. James Kent, 6338 Winona, San Diego, spoke in support. Fred Zuill, 13636 Outlook Road, expressed his concerns. Lisa and Mike Vaughn, 13951 York Avenue, spoke in support. Robert Lamagno, 103083 Wimberly Square, San Diego, applicant, spoke in support. Motion by Mayor Cafagna, seconded by Councilmember Rexford, to close the public hearing, issue a Mitigated Negative Declaration and adopt Planning Resolution No. P-00- 80, entitled, "A Resolution of the City Council of the City of Poway, California Approving Environmental Assessment and Tentative Tract Map No. TTM 99-01R Assessor's Parcel Number 314-192-38, 39, 68." Motion carried 4-1 with Councilmember Emery voting no. Council then directed staff to prepare an Old Poway Specific Plan Amendment to address the issue of the placement and materials for sound walls in the Specific Plan area. Additionally, staff will schedule the design for the wall for Council review. ITEM 3 (203-02) TENTATIVE PARCEL MAP 93-05(TE-2) TIME EXTENSION APPLICANT: BILL YEN 7O57 Page 5 - CITY OF POWAY - October 3, 2000 Mayor Cafagna opened the public hearing. Staff report by City Manager Bowersox. This is a request for a one-year time extension to Tentative Parcel Map 93-05, an approved subdivision of a 2.3-acre property into three residential parcels at the northeast corner of Adah Lane and Chancellor Way. There was no one present wishing to be heard. Motion by Councilmember Higginson, seconded by Councilmember Rexford, to close the public headng and adopt Planning Resolution No. P-00-81, entitled, '% Resolution of the City Council of the City of Poway, California Approving TPM 93-05 (RE-2), A One-Year Time Extension, and Rescinding Resolution No. P-98-32 For Tentative Parcel Map 93-05, AssessoYs Parcel Numbers 323-262-09,10." Motion carried unanimously. ITEM 4 (203-04) VARIANCE 00-10 APPLICANT: BOB GOODBODY Mayor Cafagna opened the public hearing. This is a request for a Variance to allow a 252-square-foot bedroom addition to observe a 16-foot side yard setback when a 20 foot setback is required at 15517 Oakstand Court. Mayor Cafagna noted that the applicant had withdrawn the request prior to the meeting. There was no one present wishing to speak. Motion by Deputy Mayor Higginson, seconded by Councilmember Goldby, to close the public hearing and accept the withdrawal of the request for Variance. Motion carried unanimously. ITEM 5 (203-04) VARIANCE 00-12 APPLICANT: OLD COACH REALITY Mayor Cafagna opened the public hearing. This is a request for a Variance to allow a seven-foot-high wall with six-foot entry gates for the entrance to seven lots of a gated community at Cascade Crossing, east of Old Coach Road. There was no one present wishing to speak. 7058 Page 6 - CITY OF POWAY - October 3, 2000 Motion by Councilmember Goldby, seconded by Deputy Mayor Higginson, to close the public hearing and adopt Planning Resolution No P-00-82, entitled, "A Resolution of the City Council of the City of Poway, California Approving Variance 00-12 Assessor's Parcel Number: 277-200-01 & 02 (Adjacent to)." Motion carried 4-1 with Councilmember Emery voting no. MAYOR AND CITY COUNCIL-INITIATED ITEMS 14.
