REGULAR MEETING
OCTOBER 10, 2000
The October 10, 2000, regular meeting of the City Council of the City of Poway,
was called to order at 7:00 p.m., by Mayor Cafagna at the City Council Chambers, 13325
Civic Center Drive, Poway, California.

Boy Scout Troop #688 Presented the Colors and Led the Pledge of Allegiance.
PRESENTATION
Mayor Cafagna announced that Assemblymember Charlene Zettel had a conflict arise in
her schedule and therefore was unable to be present to provide an update on the State
Legislative Session, however, she would be present at the October 17, 2000 Council
meeting.
PUBLIC ORAL COMMUNICATIONS
Mayor Cafagna explained the procedure for Public Oral Communications. The following
people were present wishing to speak:

Susan Batterton, 12236 Pepper Tree Lane, spoke regarding the impact of noise from the
Big Stone Lodge on her family and neighborhood.
Bill Cross, 13105 Corona Way, thanked the Council and staff for the new kitchen facilities
at the Weingart Senior Center and invited all in attendance to the remodel celebration and
ice cream social being held Thursday, October 19th. He also invited all in attendance to
the Granny's Attic antique appraisal event being held at the Center on Friday, October
13th.
The following people spoke in support of Ham Radio Antennas and requested Council
assistance in modifying the City ordinance to make it less restrictive:

Motion by Councilmember Emery, seconded by Councilmember Goldby, to approve the
Consent Calendar as follows:
Ratification of Warrant Register for the period of September 18-22, 2000.

9. Approval of Appropriation of $67,300 from the Low and Moderate Income Housing
Fund for David Paul Rosen & Associates to Prepare a Comprehensive Affordable
Housing Strategy Update for FY 2000/01 through FY 2004/05. (602-01 #268R)
10. Approval of Agreement with Personnel Concepts, Inc. and Appropriation of
$40,000 for City-wide Classification and Compensation Study. (602-01 #1439)
Motion carried unanimously.
ITEM 1 (701-04)
ORDINANCE NO. 531/FIRST READING
MAYOR AND COUNCIL COMPENSATION
Mayor Cafagna opened the public hearing and read the title of Ordinance No. 531, "An
Ordinance of the City of Poway, California, Amending Title 2, Chapter 2.04 of the Poway
Municipal Code by the Amendment of Section 2.04.020 to Increase the Compensation of
the Members of the City Council and the Mayor." Staff report by City Manager Bowersox.
The City Council directed staff to annually review the City Council salary. This item has
not been scheduled by staff since the compensation increase in December 1998. The
proposed Ordinance will provide for an increase of $73.63 per month for the Members of
the City Council and $373.63 per month for the Mayor, beginning December 5, 2000.
There was no one present wishing to speak.
Motion by Councilmember Goldby, seconded by Councilmember Emery, waive further
reading. Motion carried unanimously.
Motion by Councilmember Goldby, seconded by Counciimember Emery, to continue the
public hearing to October 24, 2000 for second reading and adoption. Motion carried 4-1
with Deputy Mayor Higginson voting no.

VARIANCE 00-17
MINOR DEVELOPMENT REVIEW 00-105
APPLICANTS: JOHN AND SANDY GONNERMAN
Mayor Cafagna opened the public hearing. Staff report by City Manager Bowersox. This
is a request for approval of a previously approved project that expired prior to construction
for a 3,192 square foot, two story residence on a vacant 0.55 acre property located at
13411 Stone Canyon Road. A Variance is requested to allow a 10 foot side yard setback
along the easterly property line and a 9 foot setback along the westerly property line

when 20 foot side yard setbacks are required.
There was no one present wishing to speak.
Motion by Councilmember Emery, seconded by Councilmember Goldby, to close the
public hearing and adopt Planning Resolution No. P-00-83 entitled, '% Resolution of the
City Council of the City of Poway, California Approving Vadance 00-17 and MDRA 00-105
Assessor's Parcel Number 275-181-08." Motion carried unanimously.
MAYOR AND CITY COUNCIL-INITIATED ITEMS

Councilmember Emery requested and received concurrence to have staff provide
an analysis of the legality of motorized scooters, licensing requirements, whether
or not they are legal on sidewalks and whether the helmet law is applicable.
14.
Councilmember Goldby requested staff evaluate adding skateboard friendly
elements to selected City parks, including researching the issues of liability and
compatibility.

Councilmember Rexford requested and received concurrence to authorize staff to
actively participate in the Miramar MV22 Osprey ElS process. She also
announced that the Governor had recently signed SB 1462 to become effective
January 1, 2001, which requires any professional or amateur rodeo in any city or
county must ensure that an on-site veterinarian is present at all times during the
rodeo performance or on-call and available to arrive at the rodeo within one hour
after determination of an animal injury which requires veterinarian treatment.
Additionally, electric prods or similar devices cannot be used on an animal in a
holding chute, unless necessary to protect participants or spectators.

Mayor Cafagna reminded all in attendance that tonight at midnight was the
deadline to register to vote in the November 7, 2000 election and announced that
the Poway City Clerk's Office would be open to accept voter registration
applications.
ADJOURNMENT
Mayor Cafagna adjourned the meeting at 7:50 p.m. on motion by C~ouncilmember Goldby,
