CC 2001 01-23CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING JANUARY 23, 2001 The January 23, 2001, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Cafagna at the City Council Chambers, 13325 Civic Center Drive, Poway, California. The following people were present wishing to speak: Kitty Miller, 12528 Arabian Way, Representing the Poway Chamber of Commerce, informed the Council that Miss Poway would be participating in the Miss San Diego Pageant this Saturday at the Point Loma Nazarene College. Howard Stacklin, 13149 Tobiasson Road, expressed his views on the energy situation throughout the State. 7143 Page 2 - CITY OF POWAY - January 23, 2001 CONSENT CALENDAR Mayor Cafagna stated that he had received a request from the public to pull Item 7.1 for discussion. Motion by Deputy Mayor Goldby, seconded by Councilmember Higginson to approve the remainder of the Consent Calendar as follows: Adoption of Resolution No. 01-004 - Establishing a 401(a) Money Purchase Retirement Plan to be Administered by the ICMA Retirement Corporation and authorizing the entering into of an agreement for said administration. (602-01 # 1462) Authorization to use a selected source vendor (Air Purification Systems of San Diego) for the purchase and installation of a diesel exhaust extraction system at Fire Station I in the amount of $38,015. (601-04) Adoption of the Disadvantaged Business Enterprises (DBE) Program and Annual Plan goal of 10% for the period of October 1, 2000 through September 30, 2001. (1502-17) Adoption of Resolution No. 01-005 - Approving the Submittal of an Application for the Park Playground Accessibility and Recycling Grant from the California Integrated Waste Management Board. (401-30) ITEM 1 (701-04) ORDINANCE NO. 534/SECOND READING ESTABLISHING A REDUCED SPEED LIMIT OLD POMERADO ROAD BETTE BENDIXEN PARK Mayor Cafagna opened the public hearing and read the title of Ordinance No. 534, "An Ordinance of the City of Poway, California Adding To Section 10.32.010 Establishing A Reduced Speed Limit On Old Pomerado Road Adjacent to Bette Bendixen Park." Staff report by City Manager Bowersox. This ordinance reduces the speed limit to 25 miles per hour on Old Pomerado Road adjacent to Bette Bendixen Park between the hours of 6:00 a.m. and 9:00 p.m. There was no one present wishing to speak. Motion by Deputy Mayor Goldby, seconded by Councilmember Emery, to close the public hearing, waive further reading and adopt Ordinance No. 534. Motion carried unanimously on a roll call vote. 7144 Page 3 - CITY OF POWAY - January 23, 2001 ITEM 2 (203-21) SOUTH POWAY SPECIFIC PLAN AMENDMENT 84-01WW MINI-PARK REQUIREMENT Mayor Cafagna opened the public hearing. Introduction by City Manager Bowersox. Staff report by Director of Development Services Fritz. This Specific Plan Amendment was initiated by the Council on December 19, 2000, to amend the South Poway Specific Plan pertaining to the mini-park requirement as a development feature within the Business Park. Amendment of the South Poway Specific Plan is recommended to revise the mini- park requirement and to allow on-site passive or active recreational areas with individual development review applications as an alternative to providing a mini-park. The following people were present wishing to speak: Neville Bothwell, 3575 Kenyon Street, San Diego, representing Tech Business Center, spoke in support of the proposed amendment. Judd Halenza, 7955 Dunbrook Road, San Diego, representing Judd partners II, LLC spoke in support of the proposed amendment. Councilmember Emery stated he was opposed to any change to the requirement for mini- parks. General discussion ensued with concerns being expressed at the elimination of a requirement for mini-parks and the desire to see possibly both mini-parks and on-site recreation areas. Motion by Councilmember Rexford, seconded by Mayor Cafagna, to continue the public hearing to February 6, 2001 to allow for further evaluation. Motion carried 4-1 with Councilmember Emery voting "no." ITEM 3 (203-01) TENTATIVE TRACT MAP 00-01 POWAY VI EWS APPLICANT: JUDD PARTNERS II, LLC Mayor Cafagna opened the public hearing. Director of Development Services Fritz stated that this item is affected by Item No. 2 and therefore recommended it also be continued to February 6, 2001. 7145 Page 4 - CITY OF POWAY - January 23, 2001 Motion by Mayor Cafagna, seconded by Deputy Mayor Goldby, to continue the public hearing to February 6, 2001. Motion carried unanimously. ITEM 7.1 (602-01#1465) AGREEMENT ENERGY PURCHASE ENERGY SERVICE PROVIDERS Staff report by City Manager Bowersox. Over the past six months, the City's energy bills have increased significantly. This unforeseeable increase has been attributed to the lack of needed power generation capacity in the western United States; the increased cost of natural gas, severe weather conditions, and deregulation. The City has investigated alternatives to purchasing electricity from SDG&E and it appears the most viable alternative is to purchase electricity from an Energy Service Provider (ESP) and negotiate a long-term contract that will stabilize electricity pricing. Staff is therefore recommending the Council waive its formal purchasing policy requirements and authorize the City Manager to negotiate and execute an agreement. The following person was present wishing to speak: Howard Stacklin, 13149 Tobiasson Road, expressed his views on the energy crisis and how it was created. Mayor Cafagna noted that he had discussed with the City Manager, looking into acquisition of a turbine generator from San Diego based firm, Solar Turbines that could provide service to 13,000 homes. It could possibly be placed in the business park as there is a 36- inch natural gas line and an SDG&E substation. Motion by Councilmember Emery, seconded by Councilmember Rexford, to approve staff recommendation authorizing the City Manager to negotiate and enter into an agreement on behalf of the City, and have staff send a letter to the Governor. Motion carried unanimously. CITY MANAGER ITEMS City Manager Bowersox announced that Poway High School was beginning a shuttle next Tuesday for the students from Lake Poway to the high school. 7146 Page 5 - CITY OF POWAY - January 23, 2001 CITY ATTORNEY ITEMS 9. Bowersox, City of Poway - Buyer Human Shihadeh - Seller MAYOR AND CITY COUNCIL-INITIATED ITEMS 11. Deputy Mayor Goldby requested a future agenda item on Rancho Encantada. 13. Councilmember Rexford requested a future agenda item for a contribution to the Escondido Humane Society to assist in their recent fire loss. She also announced that the annual April Poway Dog Park Fundraiser would benefit the Escondido Humane Society. 14. Mayor Cafagna recognized City employee Steve Streeter in the audience who was retiring after 13 years of service to the City. CLOSED SESSION Mayor Cafagna called for a Closed Session as requested by the City Attorney at 8:07 p.m. CALL TO ORDER AND ADJOURNMENT Mayor Cafagna adjourned the meeting at 8:31 p.m. with all Councilmembers present. Upon motion by Councilmember Higginson, seconded by Councilmember Rexford Mayor Cafagna adjourned the meeting at 8:32 p.m. in the memory of Jenna Figueroa.
