CC 2001 03-06CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING MARCH 6, 2001 The March 6, 2001, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Cafagna at the City Council Chambers, 13325 Civic Center Drive, Poway, California. PRESENTATIONS A) Mayor Cafagna presented a 15-Year Service Award to Street Maintenance Supervisor Tony Bowers and a 20-Year Service Award to City Manager Jim Bowersox. 7175 Page 2 - CITY OF POWAY - Mamh 6, 2001 Mayor C and c) Cafagna requested and received Council concurrence to hear Presentation Item Public Oral Communications prior to the Annual State of the City Address. Mayor Cafagna presented Poway Unified School District Board Representatives Steve McMillan, Penny Ranftle, Linda Vanderveen, Acting Superintendent John Collins and Director of School/Community Relations Sharon Raffer with a Certificate of Excellence as a "Gold Medal School District" from Expansion Management Magazine. PUBLIC ORAL COMMUNICATIONS Mayor Cafagna explained the procedure for Public Oral Communications. The following person was present wishing to speak: Vicki Gordon, 17206 Pinot Place, representing the Poway High School PTSA announced a Campus Clean-Up Day, Saturday, March 31st from 8 a.m. to 3 p.m. and invited all in attendance to participate. Presentation B was heard at this time. B) Mayor Cafagna presented his Annual State of the City Address. CONSENT CALENDAR (701-01) Motion by Deputy Mayor Goldby, seconded by Councilmember Emery, to approve the Consent Calendar as follows: 1. 2. Ratification of Warrant Register for the Period of February 5-9, 2001. (401-10) Approval of Minutes - City Council February 13, 2001 - Regular Meeting Denial of Claims against the City: A) Richard Kemplin; B) Brenda Warter. (704-13) Approval of Neighborhood Loan Program for Improvements to Jerome Drive. (401-27) Update of City Council Goals and Objectives. (202-01) o 7176 Page 3 - CITY OF POWAY - Mamh 6, 2001 Approval of Final Map for Tentative Parcel Map 00-08, Tech Business Center, LLC, Owner. Property located at Kirkham Way and Tech Center Court. (203-02) o Authorization to Initiate an Inflow and Infiltration Flow Reduction Program for the Sanitary Sewer System. (1203-01) 8.1 Award of Bid for 11 Truck Beds to Rector Equipment and Truck Bodies in the amount of $97,537.04 (601-03) Motion carried unanimously. CITY ATTORNEY ITEMS 10. City Attorney Eckis requested the following Closed Sessions with exception of 10F which he stated would not be held. He then stated that no special findings or report out would be made: A. Conference with Real Property Negotiator per Government Code §54956.8 Property: 12257 Old Pomerado Road, APN 317-232-12 Negotiating Parties: James Bowersox, City Manager, Buyer Mr. and Mrs. Doyle, Seller Conference with Real Property Negotiator per Government Code §54956.8 Property: 13644 Poway Road, APN 317-130-47 Negotiating Parties: James Bowersox, City Manager, Buyer NewPlan Inc., Seller Conference with Legal Counsel - Anticipated Litigation Significant Exposure to Litigation Government Code §54956.9(b) Number of potential cases: 1 Endangered Habitats League Notice of Intent to File Suit on file in the Office of the City Clerk. Conference with Legal Counsel - Threatened Litigation (NOT HELD) Discussion on whether or not to initiate litigation Government Code §54956.9(c) Number of potential cases: 1 7177 Page 4 - CITY OF POWAY - March 6, 2001 MAYOR AND CITY COUNCIL-INITIATED ITEMS 12. Councilmember Goldby requested reconsideration of a City Flag Design with a blue background color as on Attachment B. Motion by Councilmember Rexford, seconded by Mayor Cafagna to approve the design with a blue background color. Motion carried unanimously. 15. Mayor Cafagna requested and received Council concurrence to hold a pre- development conference on April 5, 2001, to consider a request from GEICO to install a lightning protection system on the roof of their building at 14111 Danielson Street. This request would require an amendment to the South Poway Specific Plan due to height limitations being exceeded. (203-18) CLOSED SESSION Mayor Cafagna called for Closed Session at 8:00 p.m. as requested by the City Attorney. CALL TO ORDER AND ADJOURNMENT Mayor Cafagna called the meeting back to order at 8:36 p.m. with all members present and adjourned the meeting at 8:37 p.m., upon motion by Councilmember Rexford, seconded by Councilmember Emery.
