bu:ildings on 'e.i,therslde and the open wrought iron fence on the south
property line assures adequate light and air circulation for the sub-
ject lot.

The granting of this variance does not constitute a special privilege
inconsistent with the limitations upon ot~er properties in the vicinity
and zone 'inw~ich s'uch property is situated, in that other lots in the
subdivision have six foot high privacy fencing along side and rear pro-
perty lines arid the variance is necessary to secure this right for the
subject lot.
5.
T~egranti ng of this variance does not ,a 11 ow a use or acti vity whtch is
not otherwtse expressly authorized by the zoning' regul'ation governing
the parcel of property because side and rear property 1 ine fencing
is required by the Zoning Ordinance for smaTler single-family lots
Granting the variance or its modification will not be incompatible with
the City of poway General Plan because of the minimal nature of the
request.

The City C6uncilhereby approves Variance 89-13 for which plans are on file
in the Planntng Services Department, are hereby approved subject to the
following conditton:
Within 30 days of approval: (1) The applicant s~,all submit in writing that
all conditions of appr6v~1 have been read and understood; and (2) the pro-
perty owner shall execute a Covenant on Real Property.
APPROVED and ADO~h:b by the City Counci 1 of the" City of Poway, State of
