RESOLUTION NO 08-004
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
DECLARING THE CITY'S INTENT TO VACATE
A PORTION OF TEMPLE STREET AND A PORTION OF BRIGHTON AVENUE
(Vacation Nos. 09-01 and 09-02)
WHEREAS, the City Council of the City of Poway intends to vacate a portion of
Temple Street and a portion of Brighton Avenue, located east of Midland Road, and
between Edgemoor Street and Adrian Street, in accordance with the procedures
provided in Part 3, commencing at Section 8300, of Division 9 of the State of California
Streets and Highways Code, and
WHEREAS, said portions of streets were dedicated for public street purposes
through the filing and recordation of the "Piermont" subdivision on May 27, 1887, and
WHEREAS, said portions of Temple Street and Brighton Avenue are excess
rights-of-way not required for public street purposes, and
WHEREAS, pursuant to the procedures provided therefore in said Chapter of the
Streets and Highways Code, a public hearing shall be held for the street vacation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Poway, California, as follows
The public hearing for the vacation of a portion of Temple Street and a portion of
Brighton Avenue shall be held on Tuesday, February 17, 2009, at 700 p.m., in the
Council Chambers at City Hall in the City of Poway, 13325 Civic Center Drive, Poway,
California.
PASSED, ADOPTED, AND APPROVED by the City Council of the City of
Poway, California, at a regular meeting this 3rd day of February 2009
