In consideration of the appraval by the City of Poway ("CITY" hereinafter) af a Building Permit to.
construct an attached 594 square tbot guesthquse, OW N ERS hereby agree that no partion af the
guesthoiJseshall ever be rented or leased as a separate unit and no. kitchen facilities shall never be
installed,
This Covenant shall run witn the land and be binding upon and inure to the benefit of the future
owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the
respective parties,
In the event that the Building Permit is. never obtained to construct the prapased addition, CITY
shall at the request of OWNERS expunge this Cavenant from the record title af PROPERTY
If either party is required to incur costs to. enfarce the provisions of this Covenant, the prevailing
party shall be entitled to. full reimbursement of all costs, including reasanable attorneys' fees, from the
other party The CITY may assign to persans impacted by the performance of this Caven ant the right to
enforce this Cavenant against OWNERS,
