owners ("OWNER" hereinafter) of real property described in Exhibit "A"'which is attached hereto and
made a part hereof and which, is commonly known as Assessor's Parcel Number 278~461~31-00
located at 14234 Harrow Place, Poway, CA ("PROPERTY hereinafter), In consideration of approval
of a Building Permit to construct a 676-square-foot guesthouse.on the.referenced property by the City
ofPoway.("CITY" hereinafter), OWNER herepy agrees that no portion of the guesthouse shall ever be
-rented or leased, as a separate unit and kitchen facililies shall never be installed,
This Covenant.shall run with the land and be binding upon and inure to the benefit af lhefuture
owners, encumbrances, successors,heirs, persorial representatives, transferees and assigns of the
respective parties,
In the event that building'permits are never obtained to construct the proposed addition at the
request of the OWNER, the CITY shall expunge lhis Covenant from the record title of the
PROPERTY -
If either party is required to incur costs to enforce the provIsions of this Covenant, the
prevailing party shall be entitled to. full reimbursement of all costs; including reasonable attorneys'
fees, from the olher party The CiTY may assign to. persons impacted by the' performance of this
Covenant lhe right to enforce lhis Covenant against OWNER.
