COVENANT REGARDING REAL PROPERTY
James Walter Reilly and Vickie Jean Reilly, Trustees for the Reilly FamilyTrust,
dated July 7, 2000, Owners, ("OWNERS" hereinafter) are the owners ofland described
in Exhibit"A", which is attached hereto and made a par:! he~eof and which ,is commonly
known as Assessor's PacceI'Number275-282-14 ("PROPERTY hereinafter). In
consideration of approvgl ora 'building permit toconstructa 741 square foot detached
garage, which includes 494 square feet of living area, on the referenced property at
/ 13384 Fallen Leaf Road, Poway, California, by the City of Poway ("CITY" hereinafter),
OWNERS hereby agree that.no portion of the detached garage shall ever be rented or
leased, as a separate unit and kitchen facilities shall never be installed.
This Covenant shall ruh yVith the land and be binding upon and inure to the
benefit of the'future oWners,encumbrances, successors, heirs, personal
representatives, transferees and assigns of the respective parfies.
In the,eventthat building'permits are never obtained to construct the proposed
addition at the ,request of ttJeOWNERS, the CITY shall exp.unge this Covenant from the
record title cif tlie PROPERTY
If either party is required to 'incur costs to enforce the provisions, of this Covenant,
the prevailing party shall be entitled'to full reimbursement orall costs, including
reasonable attorneys' fees, from the other party The CITY may assign to persons
impacted by the performance,of this Covenantthe rightto enforce this Covenant against
