COVENANT REGARDING REAL PROPERTY
whereas Patrick Kells Baas and Maria del Rosario Moncada Baas, PROPERTY OWNER
("OWNER" her~inafter) are the owners of real property commonly known as Assessor's Parcel
Number 277-202-07 ("PROPERTY" hereinafter), and more fully described as'
LOT 46 OF CITY OF POWAY TRACT NO 89-13R UNIT NO 1, IN THE CITY OF
POWAY, COUNTY OFSAN DIEGO, STATE QF CALIFORNIA, ACCORDING TO MAP
THEREOF NO 13708,. FILED IN THE OFFICE OF THE COUNTY RECORDER OF SAN
DIEGO COUNTY, DECEMBER 17,1998.
In consideration of the approval by the City of poway ("CITY" hereinafter) of Minor
Development Review 00-13~, involving a 610 sq. ft. attached guest house, OWNER hereby
agrees that no portion of the guest house shall ever be rented or leased as a separate unit, and
that no kitchen facilities shall ever be installed.
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the eventthat Minor Development ReviewApplication 0~138 expires or is rescinded
by City Council,and building permits are never obtained to construct the proposed addition, CITY
shall at the request of OWNER ~xpUrige this CovenantJrom the record title of PROPERTY
In the event of litigation. to enforce the provision~ ofthisiCovenant, the prevailing party
shall be entitled to full reimbursement of all costs, induding'reasonable attorneys' fees, from the
other party
