COVENANT REGARDING REAL PROPERTY
FF&E II Trust ,Owner, (~OWNER" hereinafter) are lhe owners of land described in Exhibit A
which is attached hereto ahd made.a.parthereof and which is commonly known as Assessor's Parcel
Number 275-270"58 ("PROPERTY hereinafter). In. consideration of:,the approval of a building permit to
conslruct a 776 square foot gllestho[jse on the referenced prope'rty by the City of Poway ("CITY"
hereinafter), OWNER hereby agree that no portion of the pool house shall ever be rented or leased as a
separate unit and kitchen facilities shallhever be installed.
This Covenant shall run with the land.and be binding upon and inure to the benefit of the future owners,
encumbrancers, successors, heirs,. personal representatives. transferees and assigns of the respective
parties.
In the event that building permits a're never obtained. to construct the proposed addition at the request of
the OWNER, the CITY shall expunge this Covenant from the record title of the PROPERTY
If either party.is required to incur costs to enforce the provjsions of this Covenant, the prevailing party shall
be enlitled to' full reimbursemeht of ali costs, including reasonable attoroeys'fees. from the other party
The CITY may assign to persons, impacted by lhe performance of this Covenant the right 10 enforce this
Covenant against OWNER.
