owners of that certain real propertY located at 15234. Luis Street, Poway,'Califomia (hereafter, "Owners").
Whereas, Owners' real property is legally described on Exhibit"A"(hereafter, the "Property"); and
Whereas, Owners"application'fora Community Development Block.Grant Housing.Rehabilitation Loan
(hereafter, the "Loan'')-from the City of Po way has been approved and a,conditiOll'ofthe Loan is the removal of all
lead~based paint from.the Property; and
Whereas, Owners requesttha~ the Loan be funde~ and the rehabilitation work done before Owners remove
the lead-based paint from the. Property; and
Whe~e~s;a.s~a,co.nfiitjon of fi!.nding the Loan, the City requires that.,Owners covenantand,agreeto remove
all lead-based paillt from thePropertywithirisix months of the fundfug ofibe loan and that this covenant be a
restriction on the Property that runs with the.land.
NOW,THEREFORE, the Owners declare and covenant as follows:
Alllead-basedpaintshal), be removedin accordancewith.FederalHUD requirements from the
Property within six months 'of the funding of the Loan. Owners will cooperate with the County of San
Diego and the City of Po way to complete the removal.
2. In the event ,that thepaintremgv,al is not removed within. said six month period, the Loan shall be
irilinediately due and payable in full.
3 The'Property shauhe held; transferred, encumbered, used, sold, leased, and occupied subject.tothe
restrictions;and covenants'set forth herein"and'said restrictions and covenants shall run with the hind
and.be binding,upon.aUsuccessors in interest of Owners. Said covenants andrestrictiori.s'.may only-be
released bya written document executed by the City of Po way acknowledging full. satisfaction thereof.
