COVENANT REGARDING REAL PROPERTY
Ben B Ellorin and Veronica J Ellorin, PROPERTY OWNERS ("OWNERS" hereinafter)
and the Poway RedevelopmentAgency ("BUYER" hereinafter) are the owners and
buyer, respectively, of real property herein described in Exhibit A, attached hereto and
made a part hereof, which is commonly known as Assessor's Parcel Number
314-201-03 ("PROPERTY" hereinafter). In consideration of the known f100dway status
of the parcel, BUYER hereby agrees to abide by the following conditions for the
eventual development of the parcel: the lot shall be either preserved as open space, or
developed for a recreational use or similar activity as approved by the Poway City
Council through a Conditional Use Permit.
This Covenant shall run with the land and be binding upon and inure to the
benefit of the future owners, encumbrancers, successors, heirs, personal
representatives, transferees, and assigns of the respective parties.
