Scott Okeson:,;and.Kim0keson, PROPERJY..OWNERS ("OWNERS" hereinafter) are the
owners of real property described in:Exhibit Awhich is attached hereto,and made a part hereof and
which is commonly known as,Assessor's Parcel Number 275-291-06 ("PROPERTY" hereinafter),
In consideration of the approval of abuilding permit to construct a 191 square foot guest house on
the referenced property by the'Cityof Poway ("CITY" hereinafter), OWNERS hereby agree that no
portion of the guest house shall ever be rented or leased as a separate unit and kitchen facilities
shall never be installed.
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns of the respective parties,
In the event that the building permits are never obtained to construct thep.foposed addition
at the request of the OWNERS, the CITY shall expunge this Covenant from the record'title of the
PROPERTY
If either party is required to incur costs to enforce the provisions of this Cover)ant, the
prevailing party shall be entitlEid toifull reimbursement of all costs, including reasonable attorneys'
fees, from the other party The CITY may assign to persons impacted by the performance of this
