OWNERS ("OWNERS" hereinafter) are the owners of real property described in Exhibit A,
which is attached hereto and m-ade,a part hereof and which is commonly known as Assessor's
Parcel Number 275-500-10 ("PROPERTY" hereinafter), In consideration of the approval of
MDRA99c05, a request to construct a3,244-square foot home and a 384-square foot cabana on
a ,58-acre lot, located at 13668 Orchard Gate Drive in rural Residential C zone, OWNERS
hereby,agree that no portion of the cabana shall ever be rented or leased as a separate unit and
kitchen facilities,shall neverbe installed,
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns of the respective parties,
In the event that MDRA99-05 expires or is rescinded by City Council at the request of
the OWNER, CITY shall expunge this Covenant fr6mthe record title of the PROPERTY
In the event of litigation to enforce the provisions of this Covenant, the prevailing party
shall be entitled to full reimbur::;em('lnt of all costs, including reasonable attorneys' fees, from the
other party
