M. Dodds F~mily Trust, Owne~, (OWNERS" hereinafter) are the owners of land
d.3scribed in Exhibit '''l~t, v/hjd~ -i$ a~fached 'hereto andernao\S"'a: part hei60f and which is
commonly known as Assessor's Parcel Number 277-201-11, located at 14480
Cheyenne Trail, Poway, California ("PROPERTY hereinafter). In consideration of
approval of Minor Development Review 99-198 to construct a 576 square foot
guesthouse on the referenced property by the City of Poway ("CITY" hereinafter),
OWNERS hereby agree that no portion of the guesthouse or cabana shall ever be
rented or leased as a separate unit, and kitchen facilities shall never be installed.
This Covenant shall run with the land and ,be binding upon and inure to the
benefit of the future owners, encumbrances, successors, heirs, personal
representatives, transferees and assigns of the respective parties.

In,the event that building permits are 'never obtained to construct the proposed
additions, at the request of the OWNERS, the CITY shall expunge this. Covenant from
the record title of the PROPERTY
If either party is required 'to!incur costs to enforce the provisions of this Covenant,
the prevailing party shall be entitled to full reimbursement of all costs, including
reasonable attorneys' fees, from 'the other party The CiTY may assign to persons
impacted by the performance of this Covenant the rightto enforce this Covenant against
