In consideration of the approval by the City of poway ("CITY"hereinafter) of Minor Development
Review 01-013, involving a pool. house, OWNER hereby agrees that nO'portibn ofthepool house shali ever be
rented or leased as a separate unit; no kitchen facilities shal!'beinstalled,
This Covenant shall run with the land and be, binding upon 'and inure to the benefit of the future
owners, encumbrances, successors; heirs, personal representatives, transferees and assigns of the
respective parties.
In the event that Minor, Development Review application 0,1-013 expires or is rescinded by City
Council, and building permits'arenever obtained tO'construct the pr<?posed addition, CITY shall at the request
of OWNER expunge this Covenant from the record title of PROPERTY
If either party isr,equiredtoin~u~,coststo enforce the provisions9f this Covenant, the prevpilingparty
shall be entitled to full reimburseme,nt ofallcost~, including reasQ~able'attorneys' fees, from the other party
The CITY may assign to persons impacted by, the performance of this Covenant the right to enforce this
Covenant against OWNERS.
