Richard C. Eppel and Janice L. Eppel, Owners, ("OWNERS" hereinafter) are the owners of land
described in Exhibit Awhich.is attached hereto and made'a'pa'rt hereofand which is commonly known as
Assessor's Parcel Number 275-270-53:("PROPERTY hereinafter), In consideration of approval for MDRA 99.
55 and a building'permitto construct'a774 square foot guesthouse on the referenced property by the City of
Poway ("CITY"liereinafter), OWNERS hereby agree that no portion of theguesthouse shall ever be rented or
leased as a separate unit and kitchen facilities shall never be installed.
This Covenant shall run with the land and be binding upon and inure to the benefit of the .future
owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
In the eventthat building permits are never obtained to construct the proposed addition?t the request
ofthe OWNERS, the CITY shall expunge this'Covenant from the record title of the PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant, the prevailingpCirty
shall be entitled to full.reimbursement'oi all costs, including reasonable attorneys' fees, from the.other party
