Res P-09-07 RESOLuTION NO P-09-07 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 09-02 TO HOLD A FUNDRAISING CARNIVAL WHEREAS, Temporary Use Permit 09-02, the Poway Knights of Columbus, Applicant, requests approval to hold a fund raising carnival on a vacant, Poway Redevelopment Agency-owned lot at 13023 Poway Road, with parking to be accommodated at the City-owned lot at the northwest corner of Poway Road and Tarascan Drive, from Thursday, March 19, 2009, through Sunday, March 22, 2009, with hours of operation from 5'00 p,m, to 10'00 p,m, on Thursday and Friday, and 1'00 p,m, to 10'00 p,m, on Saturday and Sunday; and WHEREAS, on March 3, 2009, the City Council considered the above-referenced item, NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Poway, as follows Section 1 The City Council finds that Temporary Use Permit 09-02 is Categorically Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to Section 15304(e) of the CEQA Guidelines, as the event is temporary in nature and will have no permanent effect on the environment. Section 2: The proposed use is in accordance with the purposes and standards of Section 17,26 030,A of the Poway Municipal Code Section 3 The City Council hereby approves Temporary Use Permit 09-02, a fundraising carnival on a vacant, Poway Redevelopment Agency-owned lot on Poway Road, with parking to be accommodated at the City-owned lot at the northwest corner of Poway Road and Tarascan Drive, from Thursday, March 19, 2009, through Sunday, March 22, 2009, with hours of operation from 5'00 p,m, to 10'00 p,m on Thursday and Friday, and 1'00 p m to 10'00 P m, on Saturday and Sunday, subject to the following conditions, A The event and related offsite parking shall be conducted as shown on the site pians and application on file in the Development Services Department. B This permit is valid between the hours of 5'00 p m, on Thursday, March 19,2009, and 1000 pm, on Sunday, March 22, 2009, after which time the site shall be restored to its original condition C The carnivai site can begin setting up Monday, March 16, 2009, and shall be removed by Tuesday, March 24, 2009 Resolution No P-09-07 Page 2 D Approval of this activity shall not excuse compliance with all other sections of the Zoning Ordinance and all other applicable State, County, and City Ordinances presently in effect. E The site shall be developed in accordance with the approved site plan on file in the Development Services Department, Planning Division, except as otherwise provided herein, F Prior to the event, the applicant shall comply with the following: 1 Provide the City an insurance policy naming the City of Poway as additionally insured in the amount of $1 million, 2, Provide the Poway Redevelopment Agency an insurance policy naming the Poway Redevelopment Agency as additionally insured in the amount of $1 million 3 Vendor's licenses shall be obtained from the City of Poway Customer Services Department for all temporary sales locations, 4 Obtain a permit from the City of Poway Safety Services Department to operate a carnival. A Fire and Life Safety inspection by the Safety Services Department shall be performed prior to the opening of the carnival to the public, Additional exits from the fenced area of the carnival will be required Their location will be determined at the time of the Fire and Life Safety inspection, 5 Obtain appropriate approvals from the California Department of Alcohol Beverage Control (ABC) and the San Diego County Health Department. 6 The applicant shall have individuals designated at all times, and at specific locations, to provide liaison with representatives of the City's Safety Services and Sheriff's Departments, 7 All existing trees upon the carnival site shall be protected prior to and during the event. 8 Appropriate dust control measures shall be taken prior to and during the event. 9 The site shall not have any type of activity before 700 a,m on any day prior to, during, or following the event. 10 Both lots shall be cleared of all debris on a daily basis, and be kept in a neat and orderly manner Resolution No P-09-07 Page 3 11 Both sites shall be kept locked prior to and following the event. On days of the event, the sites shall be locked during non-operating hours of the carnival. G During the event, the applicant shall comply with the following: 1 Prior to and during the event, emergency vehicle access to any street, fire lane, building, fire hydrant, or fire sprinkler system connection shall not be blocked on either site 2, The maximum travel distance to a portable fire extinguisher shall not exceed 75 feet. 3 Provide a fire extinguisher with a minimum rating of 2A 1 OBC at any booth where the cooking of food is done 4 Provide a Class K fire extinguisher at any booth where grease producing cooking is done, 5 All compressed gas cylinders must be secured from falling over 6 Obtain a permit from the Safety Services Department for any canopy that exceeds 400 square feet or any tent that exceeds 200 square feet. 7 All driveways fronting Poway Road from the Tarascan Drive lot shall remain closed during the event. 8 A crossing guard must be present during the entire event to assist pedestrians crossing Poway Road between the Tarascan Drive parking lot and the carnival site H At the conclusion of the event, the applicant shall comply with the following: 1 Public streets, the off-street parking site, and areas within and adjoining the proposed area for the event, shall be cleared of debris, litter, temporary signs, and all other evidence of the event.
