CC 2001 10-09CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING OCTOBER 9, 2001 The October 9, 2001, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Cafagna at the City Council Chambers, 13325 Civic Center Drive, Poway, California. The following person was present wishing to speak: Alma Osnaya, 14757 Pomerado Road, owner of the Halloween Store, requested assistance in obtaining a helium balloon variance. CONSENT CALENDAR Motion by Deputy Mayor Goldby, seconded by Councilmember Higginson, to approve the Consent Calendar as follows: Ratification of Warrant Registers for the Periods of September 10-14 and September 17-21, 2001. (401-10) 6. Approval of City's Investment Report as of August 31, 2001. (408-01) Acceptance of the Old Coach Water Line Extension as a Public Water System (Improvement Plan No. 801-01-356). (705-16) Motion ITEM 1 (1301-07/602-01#1500) RED LIGHT PHOTO ENFORCEMENT PROGRAM APEC TECHNOLOGIES Adoption of Resolution No. 01-091 - Ordering the Expansion of Poway Landscape Maintenance District 83-1A and City of Poway Lighting District Zones A and C with the Annexation of APN 314-820-28 with Written Consent of Property Owner Property Description: 14620 Pomerado Road, M. Zomorrodian, Property Owner, APN 314-820-28 and Approval of Final Map for Tentative Parcel Map 99-05. (203-02/705-07/705-10) carried unanimously. Mayor Cafagna opened the public hearing. On September 25, 2001, Council gave authorization to staff to implement a new red light photo enforcement program. Staff had recommended approval of a contract with APAC Technologies for a three year initial period, extendable over two additional years. Council requested that a shorter initial term be developed. Limited availability of counsel for both parties and difficulties in development of suitable payment alternatives has prevented completion of the requested contract changes within the allowed time. Staff is therefore recommending this item be continued to October 30, 2001. 7372 Page 3 - CITY OF POWAY - October 9, 2001 There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Councilmember Rexford, to continue the public hearing to October 30, 2001. Motion carried unanimously. ITEM 2 (701-04) ORDINANCE NO. 547/FIRST READING ESTABLISHING A NEW 40 MPH SPEED LIMIT DANIELSON STREET COMMUNITY ROAD AND SCRIPPS POWAY PARKWAY Mayor Cafagna opened the public hearing and read the title of Ordinance No. 547, "An Ordinance of the City of Poway, California, Amending Chapter 10.32.010 of the Poway Municipal Code Establishing a New 40 MPH Speed Limit on Danielson Street Between Community Road and Scripps Poway Parkway." Staff report by City Manager Bowersox. Danielson Street is an industrial collector street within the South Poway Industrial Park. The industrial park has been growing rapidly over the last ten years. With this growth, traffic volumes on Danielson Street have increased significantly. It has become necessary to establish a radar enforceable speed limit on Danielson Street in order to allow for regular traffic enforcement in the area by the Sheriff's Department. An engineering and traffic survey was completed as required by Sections 22357 and 22358 of the California Vehicle Code. There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Deputy Mayor Goldby, to waive further reading and continue the public hearing to October 23, 2001 for second reading and adoption. Motion carried unanimously. ITEM 3 (701-09) PROPOSED FUNDING FOR ACTIVITIES COMMUNITY FINE ARTS ADVISORY COMMITTEE Staff report by City Manager Bowersox. The Council is being asked to appropriate $4,000 for use by the Community Fine Arts Advisory Committee to raise awareness of the presence and activity of visual and graphic artists in the community. Motion by Councilmember Emery, seconded by Deputy Mayor Goldby, to appropriate $4,000 form the General Fund Unappropriated Reserves to Account 0200-4799 for use by the Community Fine Arts Advisory Committee. Motion carried unanimously. 7373 Page 4 - CITY OF POWAY - October 9, 2001 ITEM 4 (1160-04) ALL-WAY STOP CONTROLS STONE CANYON AND DEL NORTE In October 1999, the Traffic Safety Committee reviewed a report of conditions in the vicinity of the Stone Canyon/Del Norte intersection. Council directed staff to continue to monitor the intersection and provide a status report in 12 months. This report documents findings made by City staff and the Traffic Safety Committee. The Traffic Safety Committee recommends that the all way stop signs remain and that the intersection now be reviewed. There was no one present wishing to speak. Motion by Councilmember Higginson, seconded by Councilmember Emery, to direct staff to review the intersection periodically with other stop-controlled intersections. Bowersox, City Manager/Executive Director. CLOSED SESSION Mayor Cafagna called for Closed Session at 7:20 p.m. as requested by the Assistant City Attorney.
