CC 2001 10-23CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING OCTOBER 23, 2001 The October 23, 2001, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Cafagna at the City Council Chambers, 13325 Civic Center Drive, Poway, California. PRESENTATION Mayor Cafagna presented badges to Senior Volunteer Patrol SheriffAcademy Graduates: John Agriesti, Walter Davis, John Farrell, Dave Greaney, Lee Haviland, Patrick Horgan, Patrick McMahon and Bob Rogers. Mayor Cafagna presented a Certificate of Commendation to Sean O'Hara for establishment of the Intensive Outpatient Program. 7382 Page 2 - CITY OF POWAY - October 23, 2001 PROCLAMATIONS Mayor Cafagna presented a Proclamation declaring October 23, 2001 through October 31,2001 as Red Ribbon Week to Nadine Linares. PUBLIC ORAL COMMUNICATIONS Mayor Cafagna explained the procedure for Public Oral Communications. The following person was present wishing to speak: Councilmember Emery presented a Larry Himmel - "San Diego At Large"video on the City of Poway. CONSENT CALENDAR Motion by Deputy Mayor Goldby, seconded by Councilmember Emery, to approve the Consent Calendar as follows: 3. Ratification of Warrant Register for the period of October 1-5, 2001. (401-10) Approval of Minutes - City Council October 2, 2001 - Regular Meeting October 4, 2001 - Adjourned Regular Meeting Adoption of Resolution No. 01-092 - Approving the Application for Grant Funds under the Urban Recreational and Cultural Centers, Museums, and Facilities for Wildlife Education or Environmental Education Program Under the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000 for the Blue Sky Ecological Reserve Interpretive Center. (401-30) Adoption of Resolution No. 01-093 - Approving the Application for Grant Funds for Parking Improvements for Access to Blue Sky Ecological Reserve. (401-30) Acceptance of Improvements and Release of Securities for Stowe Plaza, Tentative Parcel Map 98-17; Bond No. 167 56 20, which includes a Performance Bond in the amount of $94,800, a Payment Bond in the amount of $47,400 and Bond No. 167 69 22, which includes a Monument Performance Bond in the amount of $2,500; George Codling, Stowe Properties, LLC, Applicant. Acceptance of Improvements and Release of Grading and Improvement Bonds for Poway Corporate Center- Units 2 and 3, Tract Map 86-02R(2); Grading Bond No. 155 87 57 in the amount of $186,000, Performance Bond No. 167 69 66 in the amount of $391,277, Payment Bond No. 167 65 66 in the amount of $195,638 and Monument Performance Bond No. 167 69 67 in the amount of $7,100; Tech Business Center LLC, Applicant. (503-03) 11.1 Adoption of Resolution No. 01-094 - Commending Eagle Scout Brandon Nicholas Johnson. (701-17) 11.2 Adoption of Resolution No. 01-095 - Commending Eagle Scout Brian Robert Daniels. (701-17) Motion carried unanimously. ITEM 1 (701-04) ORDINANCE NO. 547/SECOND READING ESTABLISHING A NEW 40 MPH SPEED LIMIT DANIELSON STREET COMMUNITY ROAD AND SCRIPPS POWAY PARKWAY Mayor Cafagna opened the public hearing. Staff report by City Manager Bowersox. On October 9, 2001, Council introduced and had first reading of Ordinance No. 547, "An Ordinance of the City of Poway, California, Amending Section 10.32.010 of the Poway Municipal Code, Establishing a New 40 MPH Speed Limit on Danielson Street between Community Road and Scripps Poway Parkway." There was no one present wishing to speak. Motion by Deputy Mayor Goldby, seconded by Councilmember Emery, to close the public hearing, waive further reading and adopt Ordinance No. 547. Motion carried unanimously on a roll call vote. ITEM 2 (1002-03) TRANSFER OF CITY PROPERTY ILENE STREET DRAINAGE IMPROVEMENT PROJECT 7384 Page 4 - CITY OF POWAY - October 23, 2001 Mayor Cafagna opened the public hearing. Staff report by City Manager Bowersox. As part of the Ilene Street Neighborhood Drainage Improvements project, staff proposes the City transfer the City-owned parcel to the homeowners on Ilene Street after the storm drain system construction is complete. Redevelopment law requires the adoption of Resolutions by the City and Agency to consent to the sale. There was no one present wishing to speak. Motion by Deputy Mayor Goldby, seconded by Councilmember Emery, to close the public hearing and adopt Resolution No. 01-096, entitled, "A Resolution of the City Council of the City of Poway, California, Consenting to the Transfer of Property to Adjacent Property Owners Along Ilene Street, and Making Certain Findings in Connection Therewith." Motion carried unanimously. CITY ATTORNEY ITEMS 13A. City Attorney Eckis requested a discussion of Lowenstein v. City of Lafayette Amicus Brief. (704-12) CITY COUNCIL ACTION: Motion by Councilmember Emery, seconded by Councilmember Higginson, to authorize the City Attorney to join the City in an amicus brief to be written in support of the City of Lafayette. Motion carried 4-1 with Deputy Mayor Goldby voting "no." City Attorney Eckis then requested Council support to join the City in an amicus brief for a challenge to the "Pitchess" motion and protective order in Alfred v. Superior Court. Motion by Councilmember Emery, seconded by Councilmember Rexford to support the request. Motion carried unanimously. MAYOR AND CITY COUNCIL-INITIATED ITEMS 15. Deputy Mayor Goldby inquired as to investigation of the areas of concern other than the noise item responded to in the October 16, 2001 James Ward letter; requested information be provided to City employees regarding the Domestic Violence Prevention Workshops for Couples being provided by the County of San Diego Domestic Violence Service Program, and requested an update on the issue of parking vehicles on the street. 7385 Page 5 - CITY OF POWAY - October 23, 2001 18. A. Mayor Cafagna provided an update regarding restructuring of SANDAG and the proposed Airport Authority. (1503-46) Council consensus was to keep land use control. No formal action taken. B. Mayor Cafagna requested concurrence to send the proposed letter to Poway Unified School District regarding boundary adjustments. (1503-06) The following people were present wishing to speak: Cheryl Roddy, 17759 Valle Verde Susan Prioleau, 13026 Pomard Way Consensus of the Council was to incorporate the request of the speakers regarding Poway students living in North Poway between Stoneridge and Summerfield being bussed to Rancho Bernardo High in the letter to be hand carried to the next PUSD Joint Subcommittee meeting. C. Mayor Cafagna requested and received Council concurrence for appointment of the following students to the Teen Issues Committee: (701-09) Allison Baker as Alternate Sean McDonald as Teen Club Representative Alexandra Norman as Teen Club Representative ADJOURNMENT Mayor Cafagna adjourned the meeting at 8:04 p.m. upon motion by Councilmember Rexford, seconded by Councilmember Emery.
