S,H,J,A,M, Poway LLC, Owner, Bret'iAmes, Aulhorized Representative ("Owner" hereinafter) of
land described in Exhibit A which is. attached hereto and made a part hereof and which is commonly
known as Assessor's Parcei Number 277-201-02 "PROPERTY(hereinafter), In consideration of the
approval of building permit to construct a single-family home on the referenced property by the City of
Poway ("CITY" hereinafter), OWNER hereby agrees that no General Plan Amendment, Zone Change,
tentative subdivision'map or olher'discretionary land use decision shall be adopted with respect to the
property which would increase resideniiai density or intensity of use.or would permit an industrial or
commercial use other than that as permitted.by the Rural Residential zoning in effect on the property on
November 8, 1988, unless and until such action is approved by ordinance adopted by the voters of the
City at a special or general eleclion.
This Covenant shall run with the land and be binding upon and inure to the benefit of the future
owners, encumbrancers, successors, heirs, personal representatives, transferees and assigns of the
respective parties,
In the event that building permits are never obtained to construct the proposed single-family
house at the request of the OWNER, the CITY shall expunge this Covenant from the record title of the
PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant, the prevailing
party. shalLbe entitled to full reimbursement of all costs, including' reasonable attorneys' fees, from the
other party The CITY may assign to persons impacted by the performance of this Covenant the right to
enforce this Covenant against OWNER.
