COVENANT REGARDING REAL PROPERTY
William T Bailey, Owner,("OVVNER" hereinafter) of land described in Exhibit A which is attached
hereto and made a part hereof and which is,commonly known as Assessor's Parcel Number 321-271-28
"PROPERTY(hereinafter). In consideration of the approval of building permit to construct a 1,280 square
foot accessory pool cabana on the referenced property 'by the, City of Poway ("CITY" hereinafter), OWNER
hereby agrees that no portion of the'pool house shall ever be, rented or leased as a separate unit and
kitchen faciiities shall never be installed.
This Covenant shall runwith the land and be binding upon and inure to the benefit of the future
owners, encumbrancers, successors, heirs, personai representatives, transferees and assigns of the
respective'parties.
In the event that building permits are never obtained to construct the,proposed guest house at the
request of the OWNER, the CITY shall expunge this Covenant fromthe.record title of the PROPERTY
If either party is required:to incur"coststo enforce the provisions of this Covenant; the prevailing
party shall be entitled to full reimbursement of all 'costs, including reasonable attorneys' fees, from the
other party The CITY may assign ,to' persons impacted by the performance of this Covenant the right to
enforce this Covenant against OWNER.
