GORDON AND KAREN ERICKSON, husband and wife, as joint tenants hereinafter
called GRANTORS, do hereby grant, convey and dedicate to the CITY OF POW A Y, a political
subdivision of the STATE OF CALIFORNIA, hereinafter called GRANTEE, for the benefit of
GRANTEE, the CALIFORNIA DEPARTMENT OF FISH AND GAME and the UNITED
STATES FISH AND WILDLIFE SERVICE, a "Biological Open Space" easement (shown on
Exhibit A and described below) in perpetuity to maintain an open space for protection of
sensitive plant species, wildlife species and their natural habitats over, upon, and across that
certain real property, in the City of Poway, County of San Diego, State of California, described as
follows'
A portion of the Northeast Quarter of Section 8, Township ]4 South, Range I West, San
Bernardino Base and Meridian, in the County of San Diego, State of California, included in that
land described in deed to Gordon Erickson, et al recorded January 6, 1999 as Document No
1999-0006472 in the County Recorder's Office of said San Diego County, more particularly
described as follows:

pedestrian trail purposes,
b) GRANTOR covenants and agrees for himself and his successors and assigns not to
construct any structure or other thing whatsoever on the subject land,
c) GRANTOR covenants and agrees for himself and his assigns that he shall not excavate,
clear, or place sand, rock, gravel, or other material whatsoever on the subject land, No
cultivation, grazing, clearing, or removal of vegetation shall be permitted (with the exception of
brush clearing as required and approved by the Poway Planning Services and Safety Services
Departments),

d) The granting ofthis easement is for the purpose of controlling the use of the land within
the "Open Space" easement and does not authorize or imply that subject land may be used by the
general public,
e) GRANTEE shall release and vacate this easement iflegislation and regulations are revised
to deem the easement not necessary or not legally required.
1) Any beneficiary hereof may enforce this easement,
