COVENANT REGARDING REAL PROPERTY
William and Melodle Chang C'OWNERS' hereinafter) are the owners of real property described in
Exhibit A which is attached hereto and made a part hereof and which is commonly known as Assessor's
Parcel Number 314-050-57 ("PROPERTY' hereinafter). In consideration of the approval of Minor
Development Review 95-45 for the construction of a 634 square foot detached guest house by the City of
Poway ("CITY' hereinafter), OWNERS hereby agrees to abide the following conditions; 1) Owner shall not
install kitchen and 2) Owner shall not rent the unit.
This Covenant shall run with the land and be binding upon and Inure to the benetn of the future
owners, encumbrancers, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
In the event that Minor Development Review 95-45 expires or is rescinded by City Council at the
request of the OWNER, CITY shall expunge this Covenant from the record title of the PROPERTY.
I n the event of litigation to enforce the provisions of this Covenant, the prevailing party shall be
entmed to full reimbursement of all costs, Including reasonable attorneys' fees, from the other party.
