CC 2002 01-22CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING JANUARY 22, 2002 The January 22, 2002, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Cafagna at the City Council Chambers, 13325 Civic Center Drive, Poway, California. Mayor Cafagna stated that he would be adjourning the meeting in memory of Iongtime Poway resident Larry Quate and City of Poway Employee Michael Putnam. PUBLIC ORAL COMMUNICATIONS Mayor Cafagna explained the procedure for Public Oral Communications. The following people were present wishing to speak: Cathy and Larry Jensen, 13720 Utopia Road, requested Council consideration for relief from conditions imposed on MDRA 00-100. 7443 Page 2 - CITY OF POWAY - January 22, 2002 CONSENT CALENDAR Motion by Councilmember Higginson, seconded by Deputy Mayor Emery, to approve the Consent Calendar as follows: Ratification of Warrant Registers for the periods December 17 through December 21, 2001 and December 24 through December 28, 2001. (401-10) Approval of Minutes - City Council December 4, 2001 - Regular Meeting December 11, 2001 - Regular Meeting December 18, 2001 - Canceled Regular Meeting December 25, 2001 - Canceled Regular Meeting January 1, 2002 - Canceled Regular Meeting Approval of Final Map for Tentative Parcel Map 01-01, to subdivide a 12.9-acre property into 2 lots, Ross Rizzo, Applicant. Property located at 13330 Paseo Del Verano. APN: 273-100-24. (203-02) Adoption of Resolution No. 02-006 - Establishing Stop Controls on Brookstone Drive at Stoutwood Street. (1160-01 ) 10. Adoption of Resolution No. 02-007 - Ordering the Vacation of Portions of the Pedestrian/Equestrian Easements located in Lot B of Tract No. 89-05 of Map No. 14040, Poway Summit Estates, Inc., Applicant (Vacation No. 01-04). APN: 321-420-15. (1002-06) 10.1 Adoption of Resolution No. 02-008 - Commending Eagle Scout Christen Peter Jensen. (701-17) Motion carried unanimously. Mayor Cafagna requested and Council concurred to hear the Agenda out of order with Item Nos. 3, 3A, 3B prior to 1 and 2. ITEM 3 (203-04/203-10) VARIANCE 01-12 HILLSIDE/RIDGELINE MINOR DEVELOPMENT REVIEW 01-70 APPLICANT: PAT BONAGUIDI/OWNER: ED SCOTT Mayor Cafagna opened the public hearing. Introduction by Deputy City Manager Riley. Staff report by Development Services Director Fritz. This is a request to construct a 4,500- square-foot, split-level, two-story residence on vacant property at 14637 Twin Peaks Road. 7444 Page 3 - CITY OF POWAY - January 22, 2002 ................. A Variance is also requested to allow a 25-foot front yard setback when 40-feet is required. APN: 321-250-08. The following people were present wishing to speak: EIIwood Floto, 14448 Range Park Road, expressed opposition to development and the impact on the area. Michael Rothbart, 14441 Range Park Road, expressed opposition due to trail and fire safety concerns. Harry Bloom, 14621 Twin Peaks Road, expressed opposition due to concerns with increased development in the area, destruction of the pdvate road by heavy equipment and failed promises of another developer in the area. Pat Bonaguidi, 10755 Scripps Poway Parkway, Applicant, spoke in support of the proposed project. Matt Peterson, 530 B Street, #1700, San Diego, Attorney for Bonaguidi, spoke in support of the proposed project. Motion by Mayor Cafagna, seconded by Councilmember Higginson, to close the public hearing and adopt Planning Resolution No. P-02-02, entitled, "A Resolution of the City Council of the City of Poway, California Approving Variance 01-12 and Hillside/Ridgeline MDRA 01-70, Assessor's Parcel Number 321-250-08." Motion carried unanimously. ITEM 3A (1204-13) DRAFT JURISDICTIONAL URBAN RUN-OFF MANAGEMENT PLAN Introduction by Deputy City Manager Riley. On February 21,2001, the Califomia Regional Water Quality Control Board, San Diego Region (SDRWQCB) issued National Pollutant Discharge Elimination System (NPDES) Permit No. 2001-01 governing waste discharge requirements for storm water and urban runoff. The permit requires a higher level of field inspection, more intense monitoring and increased maintenance by the City. Additionally, the City must take appropriate action to prevent and reduce discharges of pollutants and runoff flow in all phases of urban development including: planning, construction and existing development. A PowerPoint presentation (copy on file in the Office of the City Clerk) was made by City Consultant D-Max Engineering, covering this program. Council concurred to docket the item for consideration and adoption at the February 12, 2002 City Council Meeting. 7445 Page 4 - CITY OF POWAY - January 22, 2002 ITEM 3B (1204-13) PROPOSED STORM WATER MANAGEMENT PROGRAM Introduction by Deputy City Manager Riley. The City of Poway is a copermittee under National Pollutant Discharge Elimination System (NPDES) Permit Order No. 2001-01 adopted on February 21, 2001 by the San Diego Regional Water Quality Control Board (SDRWQB). The new Permit mandates Poway to expand its role in storm water pollution prevention. It requires a higher level of field inspection, more intense monitoring, and elevated levels of maintenance. Public Works Director Howell and Development Services Director Fritz then presented a brief PowerPoint presentation (copy on file in the Office of the City Clerk) on the proposed program. Motion by Deputy Mayor Emery, seconded by Councilmember Higginson, to docket the item for consideration and adoption at the March 26, 2002 City Council Meeting. Motion carried unanimously. ITEM 1 (701-04) ORDINANCE NO. 552/SECOND READING STORM WATER MANAGEMENT AND DISCHARGE CONTROL Mayor Cafagna opened the public hearing and read the title of Ordinance No. 552, "An Ordinance of the City of Poway, California Amending In Its Entirety Chapter 13.09 of the Poway Municipal Code for Storm Water Management and Discharge Control." Them was no one present wishing to speak. Motion by Deputy Mayor Emery, seconded by Councilmember Higginson, to waive further reading. Motion carried unanimously. Motion by Deputy Mayor Emery, seconded by Councilmember Higginson to close the public hearing and adopt Ordinance No. 552. Motion carried 4-1 on a roll call vote with Councilmember Goldby voting "no." ITEM 2 (701-04) ORDINANCE NO. 553/SECOND READING AMENDING TITLE 16 OF THE POWAY MUNICIPAL CODE EROSION AND DRAINAGE Mayor Cafagna opened the public hearing and mad the title of Ordinance No. 553, "An Ordinance of the City of Poway, California Amending Title 16, Division III, of the Poway Municipal Code by Amending and Addition of Certain Sections Pertaining to Erosion and Drainage." There was no one present wishing to speak. 7446 Page 5 - CITY OF POWAY - January 22, 2002 Motion by Deputy Mayor Emery, seconded by Councilmember Higginson, to waive further reading. Motion carried unanimously. Motion by Deputy Mayor Emery, seconded by Councilmember Higginson, to close the public hearing and adopt Ordinance No. 553. Motion carried 4-1 on a roll call vote with Councilmember Goldby voting "no." CiTY ATTORNEY ITEMS 12. City Attorney Eckis requested the following Closed Session: Conference with Real Property Negotiator Government Code §54956.8 Property: Lot 2 of Map No. 14230, South side of Kirkham Way approximately 300 feet west of Stowe Drive Negotiating Parties: James L. Bowersox on behalf of the Poway Redevelopment Agency, Buyer Lloyd Wells, Seller Under Negotiations: Price and Terms CLOSED SESSION Mayor Cafagna called for Closed Session as requested by the City Attorney at 8:30 p.m. CALL TO ORDER AND ADJOURNMENT Mayor Cafagna called the meeting back to order at 8:41 p.m. with all members present and adjourned the meeting at 8:42 p.m. in memory of long time Poway resident Larry Quate and City Employee Michael Putnam, upon motion by Councilmember Rexford, seconded by Councilmember Higginson.
