RESOLUTION NO. 97-045
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA,
ACCEPTING THE DEDICATION FOR STREET PURPOSES OF CERTAIN ONE-FOOT WIDE
STRIPS DESIGNATED AS LOTS HAND K OF VALLE VERDE COUNTRY CLUB ESTATES,
MAP NO. 4683, TAM O'SHANTER DRIVE AND INDIAN CANYON LANE
WHEREAS, on the map of Valle Verde Country Club Estates, recorded on
December 21, 1960, as Map No. 46B3, in the Office of the County Recorder,
there is offered for dedication for street purposes certain one-foot wide
strips at the northerly ends of Tam O'Shanter Drive and Indian Canyon Lane.
WHEREAS, on said Map No. 4683 the County of San Diego rejected the
offers of dedication of said one-foot wide strips as hereinafter more
particularly described, and
WHEREAS, the State of California Government Code (Subdivision Map Act)
Section 66477.2(a)provides that a rejected offer of dedication shall remain
open and may be accepted by resolution at any later date, and
WHEREAS, because of the approval of the final map of City of Poway Tract
89-13R, Phase I, Units 1 and 2, it is in the best public interest of the City
of Poway that said one-foot wide strips be now accepted for public use for
street purposes.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Poway does determine and order as follows:
1. The City of Poway hereby rescinds the rejection of said strips,
and does hereby accept for public use for street purposes the
following:
Lots Hand K designated "Lot H and Lot K
reserved for future street" on Valle Verde
Country Club Estates, Map No. 4683,
recorded on December 21, 1960 in the
Office of the County Recorder of San Diego
County, California.
2. The City Clerk is hereby authorized and directed to certify to the
passage of this resolution and to cause its recordation in the
Office of the Recorder of San Diego County.
