A variance is also requested for an encroachment into the required side yard setback, and WHEREAS, the request for a variance for the height of the sanctuary building was later withdrawn; and WHEREAS, .it is the desire of the congregation to establish the land use right for a future private religious day school and to expand the number of students enrolled in the school program from 44 to 72istudents; and WHEREAS, the applicant has requested City Council approval of a bell tower for the new sanctuary bufldingwhich will be 60 feet in height and one on the education building at 42.5 feet in height; and WHEREAS, on February 15, 2000, the City Council held a duly advertised publiC hearing to solicit comments'from the public, both. pro and con, relative to this application, and the City Council considered the above-referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1 The City Council finds the project to be Categorically Exempt pursuant to Section 15302 (Class 2) and Section 15305 (Class 5) of the California Environmental Quality Act because the use will operate within existing facilities and it entails a minor alteration in a setback limitation that does not result in the creation of a new parcel. Section 2, The findings in accordance with Government Code Section 66020 for the public irnprovements are made as follows: A. The design and improvements of the proposed development are consistent with all elements of the Poway General Plan as well as City ordinances because all necessary services and facilities will be available to serve this project. New fire hydrants will be required to be added along with the construction of the new education and church sanctuary bUildings in order to provide adequate fire protection to the adults and children attending the facility throughout the week, Section 3 The findings in accordance with Section 17.48.070 of the Poway MUnicipal Code for Conditional Use Permit 88-19(M2) approving the reconstruction and expansion of an existing church, the increase.in the number of children in the existing school from 44 to 72, and establishment of the right for a future day school are made as follows: A. That the location, size, design, and operating characteristics of the use are in accordance with the.general plan and the zoning ordinance in that a church facility with accessory school facilities is found to be a compatible semi-public land use in a residential zone when governed by a conditional use permit. B That the location, size, design, and operating characteristics of the church and school facilities will De compatible with and will not have an adverse effect or be materially detrimental to adjacent uses, buildings, or structures, because the church facility has been operating successfully in the same location for more than twenty years and the school has operated for six mOnttis. The proposed expansion is a response to an increase in the size of the parish which is made up partly of surrounding residents. C That the location and operating characteristics ofthe church and school facilities will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the area for.the reasons stated above. D That there will be no significant harmful effects upon environmental quality and natural resources in thaHhe use will operate within an.existing building envelope including parking on a previously developed site, Natural areas along the southeast and eastern sides of the property will remain natural. E. That the generation of trafficwill not adversely impact the surrounding streets and/or the City's Circulation Element, in that the use will operate on an existing. developed church property where existing improvements and' sufficient off-street parking are in place. . 3965 . Section 4' The findings, in accordance with Section 17.50.070 of the Poway Municipal Code for Variance 99-17 approving the reduction in the side yard setback from 50 feet to 15 feet made as follows: A. Setback Reduction: That there are special circumstances applicable to the property and because of this the strict application of the zoning ordinance deprives the property of privileges enjoyed by other properties in the vicinity with the identical zoning classification in that the property is sloping and contains significant rock outcroppings. The building area is, therefore, restricted to the portions of the lot which have been previously developed. B Setback Reduction: That granting of the variance or its modification is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and land use designation for which the variance is being sought in that it will ailow the property to be developed to a comparable level as other lots within the vicinity that do not have significant rock outcroppings. C Setback Reduction: That granting the variance or its modification will not be materially detrimental to th.e public health, safety, or welfare, or injurious.'to the property or improvements in such vicinity and zone in which the property is located in that the church property and the proposed buildings will be sufficiently lower in elevation than the closest residences to the south. D Setback Reduction: That the granting of this variance does not constitute a special privilege inconsistent with the limitation upon other'properties in the vicinity and zone in that the variance will allow the property to be developed in the same location as.the original church sanctuary and religious education and play areas are presently located, reducing the overall disturbance to the site. E. Conditional Use Permit 88-19(M2) and Development Review 99-23 will allow two phases of development which are as follows: Phase 1, expansion of the school licensed for an additional 28 children, for a total enrqllment of 72 children with the construction of a new 12,575,square-foot, two-story over a basement.education building and; Phase 2, the replacement of the existing 5,592 square-foot. sanctuary building with a new 16,395 square,footsanctuary containing a basement and a mezzanine and establ.ishment of a future day school; and Variance 99-17 to reduce the side yard setback from 50 feet to 15 feet are hereby approved subject to the following conditions: A. Conditions of approval for Conditional Use Permit 88-19 and modification to Conditional Use Permit 88-19(M) approving the school are included here by reference and remain in full force and effect. Approval of a new day school will require a minor modification to the CUP at the time when the parish wishes to move forward with that proposal, specifying the humber of students, hours of operation and related details. B. Within 30 days of approval (1) the applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property C The uses conditionally granted by this approval shall not be conducted in such a manner as to interfere with the reasonable use and enjoyment ofthe surrounding residential and commercial uses.
