NOTICE OF LAND USE RESTRICTIONS
REGARDING ASSESSOR'S PARCEL NUMBER APN: 272-761-17
WHEREAS, the 1999 County of San Diego Secured Assessment Roll indicates that
Angelo M. Mazzone is the owner of APN: 272-761-17. This parcel is also known as Lot 17
of City of Poway Tract No. 88-01, Map No. 12123 (also known as: Highlands Ranch
Subdivision). Notice is hereby given that the subject property is burdened by land use
restrictions as identified below. Said restrictions are binding upon future owners of the
subject property; and
WHEREAS, on November 15, 1983 the City of Poway City Council adopted
Resolution No. P-83-52 approving Tentative Tract Map 83-04 (TIM 83-04), APN's: 272-
150-07 and -09. Lot 17 of the subject tract map TIM 83-04 is encumbered by an existing
San Diego Gas & Electric easement and associated overhead power line public utility.
Section K. on Page 9 of said resolution includes conditions of approval regarding "utilities"
as follows:
K. UTILITIES
1. All proposed utilities within the project shall be installed underground including
existing utilities along Circulation Element roads and/or highways less than 34.5 KV.
2. Utility easements shall be provided to the satisfaction of the serving utility
companies and the Director of Public Services.
3. The developer shall be responsible for the relocation and under grounding of
existing public utilities, as required; and

WHEREAS, on April 12, 1988 the Poway City Council adopted Resolution No. P-88-
46 approving Tentative Tract Map 88-01 (TIM 88-01), APN's: 272-150-07 and -09 for the
purpose of resubdividing the real property described above as TIM 83-04 which was
previously approved by the City of Poway by Resolution No. P-83-52 as noted in the above
recital. Lot 17 of the TIM 88-01, Map No. 12123 is encumbered by an existing San Diego
Gas & Electric easement and associated overhead power line public utility. Condition of
Approval Number 3. within Section 3: City Council Decision on Page 2. of Resolution No.
P-88-46 reads as follows:
3. All conditions of approval for TIM 83-04 (Resolution No. P-83-52) shall apply.
THEREFORE, the City of Poway hereby requests that the County Recorder record
this Notice of Land Use Restrictions on the title of said property so as to notify future
owners of the subject property that the above restrictions are binding upon said future
owners of the subject property (Lot 17 of TIM 88-01, Map No. 12123, APN: 272-761-17).
In the event the City of poway is required to take any legal action, either civil or criminal,
to enforce the terms of this Notice of Land Use Restrictions, the City shall be entitled to
direct payment of its costs of enforcement including reasonable attorney's fees and staff
time.
