CC 2002 04-16CITY OF POWAY, CALIFORNA MINUTES OF THE CITY COUNCIL REGULAR MEETING APRIL 16, 2002 The April 16, 2002, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Cafagna at the City Council Chambers, 13325 Civic Center Drive, Poway, California. Ratification of Warrant Register for the period March 18-22, 2002.(401-10) Approval of Minutes - City of Poway March 19, 2002 - Regular Meeting o Approval of Minutes - Poway Redevelopment Agency March 19, 2002 - Regular Meeting Approval of Agreement with Berryman & Henigar for Inspection Services for the NPDES Program. (602-01 #1530) o Approval of Agreement with Ninyo & Moore for Materials Testing and Inspection Services. (602-01 #1531 ) Approval of Final Map for Tentative Parcel Map 98-06, to subdivide a 2.5-acre property into two parcels. Joan Butzen, Applicant. Property is located at 14755 Budwin Lane. APN: 321-410-39. (203-02) 10. Adoption of Resolution No. 02-036 - Establishing Stop Controls on Brian Park Lane at Poway Mesa Drive. (1160-01 ) Motion carried unanimously. ITEM 1 (203-02) TENTATIVE PARCEL MAP 98-15(TE) 12792 GATE DRIVE APPLICANT: ERROL YEAGER Mayor Cafagna opened the public hearing. Staff report by City Manager Bowersox. This is a request for a ope-year time extension to a previously approved Tentative Parcel Map for the subdivision of 9.25-acres into three parcels ranging from 1.02 to 4.04-acres in size at 12792 Gate Drive. APN: 323-290-39. There was no one present wishing to speak. Motion by Councilmember Higginson, seconded by Councilmember Goldby, to close the public hearing and adopt Planning Resolution No. P-02-16, entitled, "A Resolution of the City Council of the City of Poway, California Approving Tentative Parcel Map 98-15 (TE) Time Extension and Rescinding Resolution No. P-00-35 Assessor's Parcel Number 323-290-39." Motion carried unanimously. 7509 Page 3 - CITY OF PowAY - April 16, 2002 ITEM 2 (702-02) SPECIAL ELECTION MARCH 5, 2002 BALLOT MEASURE FIRE STATIONS ON SLOPES IN EXCESS OF TEN PERCENT Staff report by City Clerk Peoples. On Mamh 5, 2002, a Special Municipal Election was held in the City of Poway to put before the voters, Proposition J, "Shall the General Plan of the City of Poway be amended to allow fire stations on property having a natural slope in excess of ten pement?" The total number of votes cast was 10,110 out of 26,755 registered voters. Proposition J passed with 7779 votes in favor (81.1%) and 1815 opposed (18.9%). It would be appropriate at this time .to adopt a Resolution declaring the results. Motion by Councilmember Higginson, seconded by Deputy Mayor Emery, to adopt Resolution No. 02-037, entitled, "A Resolution of the City Council of the City of Poway, California, Reciting the F~ct of the Special Municipal Election Held in Said City on March 5, 2002, Declaring lhe Results thereof and Such Other Matters as Provided by Law." Motion carried unani~nously. ITEM 3 (16(~1-15) FIRE STATION #3 ALTERNATIVE SITE ANALYSIS Staff report by City Manager Bowersox. This report provides a review of three optional locations for Fire Station #3 on a 57-acre site situated on the southwest corner of Ted Williams Parkway and Pomerado Road. Staff is requesting Council direction to process the Conditional Use Permit, Development Review and associated improvement plans for the project based on a location at Site #1. The following people were present wishing to speak: Dee Fleischman, 15070 Pomerado Road, made inquiry as to the environmental impacts to the site. Mary Sanborn, 12119 Wilsey Way, spoke in opposition to Site #1. Julia Harrison and her father John, 14291 Mariana Drive, spoke in opposition to Site #1. Eleanor Oakley, 12207 Wilsey Way, spoke in opposition to Site #1. Ellen Bernee, P.O. Box 823, representing the Pomerado Pines Homeowner's Association, spoke in opposition to Site #1. 7510 Page 4 - CITY OF POWAY - April 16, 2002 Motion by Deputy Mayor Emery, seconded by Mayor Cafagna, to direct staff to process the conditional use permit and development review for a Fire Station based on a location at Site #1. Motion carried 3-2 with Councilmember's Goldby and Rexford voting "no." MAYOR AND CITY COUNCIL-INITIATED ITEMS 13. Deputy Mayor Emery requested staff look into the fencing around the Kent Sycamore Tree. 14. Councilmember Goldby requested an item be placed on the April 23,2002 agenda regarding the sending of an appeal letter for the Coastal Commission's denial of the City of San Diego's sewer discharge waiver. 16A. Councilmember Rexford requested and received Council concurrence for her appointment of Margaret Zajdel to the Redevelopment and Housing Advisory Committee. (701-09) 17A. Mayor Cafagna provided Council with an update on Regional Governance options. (1503-46) Mayor Cafagna requested and received Council concurrence to cancel the May 2, 2002 workshop. ADJOURNMENT Mayor Cafagna adjourned the meeting at 8:10 p.m. upon motion by Councilmember Goldby, seconded by Councilmember Rexford to April 18, 2002 at 6:00 p.m. in the Poway Community Library- Meeting Room.
