A RESOLU1;ION OF THE CITY COUNCILOF'THE CITY OF POWAY,
CALIFORNIA, ORDERING THE SUMMARY VACATION OF A PORTION OF OLD
COACH ROAD RIGHT-OF-WAY WITHIN PARCEL 2 OF PARCEL MAP NO 17989,
PARCEL "C" OF BOUNDARY ADJUSTMEN:rNO BA 94-08 AND
LOT "A" OF CITY OF POWAY TRACT NO 89-13R, MAP NO 13339
(Vacation 00-04)
WHEREAS, the City Council of the City of Poway desires to summarily vacate a
portion of Old Coach Road right-of-way in accordance with the procedures provided in
Chapter 4, Part 3. Division,9 of the Streets and Highways Code of the State of
California, commencing at Section 8330; and
WHEREAS, said portion of Old Coach Road right-of-way was dedicated for
public street purposes to the County of San Diego, per the deed recorded on April 20,
1971 as File No 78345 of Official Records; and
WHEREAS, the City of Poway became the successor in interest to the street
right-of-way upon its incorporation on December 1, 1980; and
WHEREAS, a portion of Old Coach Road was relocated and improved in
conjunction with the development of City of Poway Tract 89-13R, referred to as Old
Coach Golf Estates; and
WHEREAS, public street rights-of-way dedications were made to the City of
Poway for the relocated alignment of Old Coach Road per documents recorded on
March 9, 2000. and May 22, 2000, as Document Nos. 2000-0119046 and 2000-
0264702 respectively; and
WHEREAS, as a result of these aforementioned street rights-of-way dedications
and improvements of the relocated Old Coach Road, an excess street right-of-way was
created,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
1 This summary vacation is made under the provisions of Chapter 4, Part 3,
Division 9 ofthe Streets and Highways Code of the State of California.

2. The City hereby finds that the portion of Old Coach Road right-of-way
within Parcel 2,ofParcel Map No. 1'7989, Parcel "C" of Boundary
Adjustment No BA 94-08 and Lot "A" of City of Poway Tract.89-13R, Map
No 13339 has been superseded by relocation of the road (Section
8330a) and has created an excess right-ofcway not required for street
purposes (Section 8334a),
3 The City hereby declares that the portion:of.Old Coach Road right-of-way
within Parcel 2'of Parcel Map No 17989, Parcel "C" of Boundary
Adjustment No. BA 94-08 and Lot "A" of City of Poway Tract89c13R, Map
No 13339, described on Exhibit A, is hereby vacated.
4 The City Clerk of the City of Poway is hereby directed to cause a certified
copy of this. resolution to be recorded in the Office of the Recorder of San
Diego County in accordai',ce with Section 8336a of said Streets and
Highways Code,
5 That from and after the date the resolution is,recorded, the vacated
portion of Old Coach Road right-of-waywitliin Parcel 2 of Parcel Map No
17989, PaIcel "C" of Boundary Adjustment No BA 94-08 and Lot "A" of
City of Poway Tract 89-13R, Map No 13339, no longer constitutes a
street [Section 8335b(4)] and that upon such recordation. the vacation is
complete (Section 8336b).
PASSED, ADOPTED AND APPROVED, by the City Council of the City of
Poway, California, at a regular meeting this 3rd day of October 2000
