MAY 14, 2002
The May 14, 2002, regular meeting of the City Council of the City of Poway, was
called to order at 7:00 p.m., by Mayor Cafagna at the City Council Chambers, 13325
Civic Center Drive, Poway, California.

Council for their support and proposed a garden railroad for Old Poway Park.

PENALTIES
Mayor Cafagna opened the public hearing and read the title of the ordinance, "An
Ordinance of the City of Poway, California, Amending Chapter 1.08 and Adding Chapter
1.10 of the Poway Municipal Code Pertaining to Administrative Citations and Penalties."
Staff report by City Manager Bowersox. This is the second reading of the ordinance.
The following person was present wishing to speak:
Dee Fleischman, 15070 Pomerado Road, requested clarification as to how the citations
would be issued.
Motion by Councilmember Goldby, seconded by Councilmember Rexford, to waive
further reading (unanimous vote), close the public hearing and adopt Ordinance No.
557. Motion carried 4-0 (roll call vote) with Deputy Mayor Emery absent.

CHANGING ZONING CLASSIFICATION
DEDICATED BIOLOGICAL MITIGATION LAND TO
OPEN SPACE-RESOURCE MANAGEMENT
Mayor Cafagna opened the public hearing. Staff report by City Manager Bowersox.
This item involves the consideration of the redesignation of land use and zoning of 53
parcels, or portions thereof, that have been acquired for, or dedicate as, biological
mitigation land pursuant to the Poway Subarea Habitat Conservation Plan. Approval
would result in the change in the land use designation and zoning on the subject parcels
from either Rural Residential-A (RR-A), Rural Residential-B (RR-B), Rural Residential-C
(RR-C), or Planned Community (PC) to Open Space-Resource Management (OS-RM)
or Natural Open Space (OS).
The following people were present wishing to speak:

Pat Paulson, 12030 Lomica Drive, San Diego, spoke in opposition.
Al Agolarui, P.O. Box 277, spoke in opposition.
John Pavin, 16155 Poway Road, spoke in opposition.
Dorothea Hover-Kramer, 15323 Skyridge Road, spoke in support.
Motion by Councilmember Higginson, seconded by Councilmember Goldby, to waive
further reading (unanimous vote) and continue the public hearing to June 4, 2002 for
second reading and adoption. Motion carried 4-0 with Deputy Mayor Emery absent.
Additionally, Council requested future dedication documents to specify the property will
be rezoned to OS-RM or OS in the future.

UPDATE
OLD POWAY REDEVELOPMENT AREA

Staff report by City Manager Bowersox. This report updates the Council on planning
efforts and activities in the Old Poway area.
The following people were present wishing to speak.
Dee Fleischman, 15070 Pomerado Road, expressed her views on where the different
amenities should be located, appearance etc.
Valerie Raymond, 12829 Soule Street, thanked Council and staff for their support on the
proposed Community Fine Arts Center.
Council concurred to direct staff to develop concept plans for public use areas,
additional parking facilities, other public amenities and to explore further the potential for
mixed use development in the west side commercial site and to proceed with the
implementation of the Old Poway Redevelopment Area. The plans to be brought back
to a Council workshop for additional input.
CITY MANAGER ITEMS
City Manager Bowersox announced that the most recent population and housing
estimates as of January 1,2001 and 2002, place Poway at 49,658.
CITY ATTORNEY ITEMS

City Attorney Eckis requested a Closed Session on Pending Litigation,
Government Code §54956.9(a), Swinton vs. City of Poway, Superior Court Case
No. GIC746770.
MAYOR AND CITY COUNCIL-INITIATED ITEMS
20A. Mayor Cafagna provided a brief update and Council discussed Regional
Governance options. (1503-46)

Mayor Cafagna requested and received Council concurrence to hold a Pre-
Development Conference for Caliber Collision Centers for consideration of an
amendment to the South Poway Specific Plan to change the land use
designation of the Stowe Business Park from Light Industrial to Light
Industrial/Outdoor Storage on June 6, 2002. (203-18)

Mayor Cafagna called the meeting back to order at 8:34 p.m. and adjourned the
meeting at 8:35 p.m. upon motion by Councilmember Goldby, seconded by
Councilmember Higginson, Motion carried unanimously with Deputy Mayor Emery
absent.
