("OWNERs"'hereinafter) arethe,ownerscif.real property,describedin,Exhibit A which isattached.hereto,and
made a part hereof and which is commonly known as Assessor's Parcel NiJinber,273-911-24 ("PROPERTY"
hereinafter), In consideration of an approved building permit to construct a 712 square foot pool house by the
City of Poway ("CITY" hereinafter): OWNERs hereby agree that the pool house shall never be rented or
leased as a separate unit and kitchen facilities shall never be installed without first obtaining the required
approvals and permits from the City of Poway
This Covenant shall run with ihe land and be binding upon and inure to the benefit of the futyre
owners, encumbrancers, successors, heirs, personal representatives, transferees and assigns of the
respective parties,
In the event that building permits are never obtained to construct the proposed guest house at the
request ofthe OWNERs, the CITY shall1expunge this Covenantfrom the record title of the PROPERTY
If either party is required to incur costs to enforc~ the provisions of this Covenant"the prevailing party
shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other party.
The CITY may assign to'persons impacted by the performance of'this Covenant the right to enforce this
Covenant against OWNERs,
