WHEREAS, Hi nor Condit i onal Use Permi t92-02, subm,itted by Ri chardWoodaman,
applicant, requests approval to operate four 'indoor batting cages within an
eXistirig building located at 12B45 Poway Road, in the Convnercial General zone;
and
WHEREAS, on October 6, 1992, the City Counci; held a duly advertised publ ic
hearing to solicit convnents from the public, both pro and con, relative to this
application

use whlch fs proposed, in that it is in an area for general
commercial uses and the intensity of the business activity is
d'irectly related to only four batting cages being available for use.

envi ronmental qual i ty and natural resources in that the usew,ill be
contained within an existing building on a fully developed ,site.

Sectinn 3: Citv Council Decision:

1. Within 30 days of approval: (1) The applicant shall submit in
wri ti ng tbat, a 11 condit ions of !pproval have b~en read arid
understood; and (2) the property owner shall execute a Covenant on
Real Property.
2. The use cond.it.ionally granted by this permit shall not be conducted
in such ,a manner as to interfere with the reasonable use and
enjoyment of surrounding light industrial uses.
APPLICANT SHALL ,CONTACT THE,DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE

1. The p;~an,ning,Servi,ces peparJment shall conduct an annual review 'of Hinor
Cond,itional Use Permit 92-02 for compliance with the conditions of
,approval. If the department has received complafnts, or the use is not in
climplia,nce, the review will be forwarded to the Council, who may add
conditions to the permft or amend existing conditions of approval.
2. In the event noise emanating from the use becomes a nuisance to the
agjacent tenants (the CHy receiVes compl aints), th,e appl icant shall hilve

1. Site shall be developed in accordance with the approved 'site plans on file

effect at 'the time of building permit issuance.
3. 'Prior to any use of the project site or business activity being commenced
thereon, all conditions of approva'l contained herein shall be completed to
the satisfaction of the Director of Planning Services.
4 . Disabled access must be provided throughout the facility for both
employees ~nd customers.
5. If the number of employees. on duty exceeds four, separate san i tary
facilities shall be provided for each sex.
SIGNS
Any signs proposed for this development shall be designed and approved in
conformance with the Sign Ordinance.
APPLICANT SHALL CONTACT THE DEPARTMENT OF SAFETY SERVICES REGARDING COMPLIANCE
WITH THE FOLLOWING CONDITIONS:
1. Building/new suite is to have new fire sprinkler system installed.
2. Minimum one hour wall construction on interior walls of new suite.
3.
Provide a key for suite for "Knox Box".
GENERALREOUIREMENTS AND APPROVAES
The minor conditional use permit shall lapse ,and shall become void October
6, 1994 i'f the site has not been occupied in accordance with the
conditional use.
