COVENANT REGARDING REAL PROPERTY
Arley G, Chugon and Nancy E. Chugon, husband and wife ?s joint tenants
( "OWNtR" hereinafter) are the owners of rea 1 property descri bed i'n Exh'i bi t A wh;'ch
ts attached hereto and made a part hereof and which is commonly known as
Assessor"s Parcel Number 278-423-03 ("PROPERTY" hereinafter). In considel'ation
of the approval of Minor Development Review 8-16 by the City6f Poway ("CITY"
hereirafter), OWNER hereby covenants and agrees for the benefit of the CITY, to
aQide by conditions of the attached resolution (Exhibit B).
This Covenant shall run with the land and be binding upon and inure to the
beneftt of the future owners, encumbrancers, successors, heirs, personal
representatives, transferees and assigns of the respective parties.
In the event that Minor Development Review 89-16 expires or is rescinded by
City Council at the request of the OWNER, CITY shall expunge this Covenant from
the record title of the PROPERTY.
If either party is required to incur costs to enforce the provisions of this
Covenant, the prevailing party shall be entitled to full reimbLJrsement of all
costs, incl udi ng reasonable attorneys' fees, from the other party. The CITY may
assi.gn to persons impacted by the performance of this Covenant the right to
enforce this Covenant against OWNER.
