WHEREAS', 'Variance 89-15., submitted by Dr. and t-lrs. James Hill, appl icant,s,
request approval of an eight and seventeen foot varjai1~e to the requi red m~inim4m
frorityard and five-foot encroachment into the requ.ired side yard setback for
the\,property located at wllio Camino del Valle in theRR-C (Rural Residential)
zone; and
~HEREAS~ on November 14, 1989, th~ City Council held a duly advertised
pub lie heari ng to so licit c:orrments from the publ i c ,\ both pro and. con, rel a ti ve
to this application.
NOW, THEREFORE, the, City Council of the City. of poway,does hereby resoJve as,
follows:
Section 1: Environmental Findings:
This project i's categorically exempt under the provision of CEQA (Class 1),
additions toex,ist.in-g structures.
Section 2~ Findi,ngs:
1. There are specia.l ci rcumstances applicable to the property (size,
shape, topography, location, and surroundihgs) , or the intended use of
the' property, ana, because of thi s, the>stri ct appHcat i on of theZoni'ng
Ordinance deprives the property of privi,1.egesenjoyed by other proper~
ties in the vic.inity under identical zoning classifications. The sub-
ject single-family.~home observ,es the same side 'yard setbacks as the
majority of older homes in the Green Va:1J'ey'area which were built to a
15 foot minimum standard under County zoning criteria, and there are
three homes in theiitined.iate neighborhood which observe similar front
yard setbacks'.
2. Granting the varijl.n~e, or its m6dific~atio~n, is necessary for 'the preser-
vation and enjoyment o.f a subs'tanfia'l property right.pos,sessed, by other
property in the same 'vicinity and zone anddenied'-to the property 'for
whi'ch the variance, is sought in that the' front entry to the home is
oriented forward on the exi.sting -c'{rcular 'd'ri,ve'ilay over which the porte
cochere is' to be located.' . " .
3. Granting ,tJ1e variance, or its mOd;'fica,tion"wfn ,not be materially
detrimental to the pubri'c health, safety or welfare, qr injurious' to
the property or improvements in such vicinity and zone in which the
property is located in tha~ the former and present additions meet all
requirements under the uniform building code.
4. Granting of th,i s variance does not. constitute a special privilege incon.-
sistent with the nmita:tions up,on, ,other properties i.n the vicir1i'ty and
zone in wh i ch s~uch property iss itullted i n that other res) den~es in the
same Vicinity. have bee'n constructed observing similar setbacks.
