RESOLUTION NO. 09-014
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWA Y, CALIFORNIA,
ESTABLISHING AN ALL-WAY STOP CONTROL AT THE
INTERSECTION OF KIRKHAM ROAD AND KIRKHAM COURT
WHEREAS, Section 21100 of the California Vehicle Code permits local authorities
to adopt by resolution traffic control measures meeting the requirements set forth under
Section 21351 of the California Vehicle Code; and
WHEREAS, Section 21351 of the California Vehicle Code permits local authorities
to place and maintain such traffic signs upon streets and highways as may be necessary to
properly indicate and carry out the provisions of the local ordinances and to warn or guide
traffic; and
WHEREAS, Section 21355 of the California Vehicle Code permits local authorities
to erect stop signs at any location so as to control traffic within an intersection; and
WHEREAS, Section 10.24.020 of the City's Municipal Code permits installation of
stop signs where the City Council has determined that there is a special hazard to life and
property by reason of lack of visibility to the drivers of vehicles approaching such
intersection; and
WHEREAS, Resolution No 05-086, adopted by City Council on October 5, 2005,
sets the guidelines to determine a special hazard to life and property condition in
accordance with Section 2B-07 "Multiway Stop Applications" of the California Manual on
Uniform Traffic Control Devices (MUTCD); and
WHEREAS, the City Council has determined that the intersection of Kirkham Road
and Kirkham Court qualifies for an all-way stop control due to lack of adequate sight
distance in accordance with the guidelines set forth in Section 2B-07 of the California
MUTCD; and
WHEREAS, the City Council has determined that an all-way stop control and
appropriate markings should be established at the intersection of Kirkham Road and
Kirkham Court.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Po way as
follows:
Section 1: In accordance with said Section 21351 of the California Vehicle Code, an all-
way stop control and appropriate markings shall be installed atthe intersection of Kirkham
Road and Kirkham Court.

PASSED, ADOPTED, AND APPROVED by the City Council of the City of Poway, at
