Southern Cal ifornia Baptist Convention ("OWNER" hereinafter) is' thE!' owner of
real property described in Exhibit A which is attached hereto' 'and made, a' part
hereof and which is commonly known Assessor's Parcel Number 323-Q60-25'
("PROPERTY" hereinafter). In consideration of the approval of a ,modificatlon to
Condit-oriaJ Use Permit 87-17 by the City of Poway ("CITY" hereinafter), OWNER
hereby covenants and agrees for the benefit of the CITY, to abide by conditions
of .the, attached resolution (Exhibit B).
This Covenant shall run with the land and be binding upqn and inure to the
tienefit.of the future owners, encumbrancers, successors, heWs, personal
repre,senta t i ves, transferees and ass i 9ns of the respecti ve parties.
In the event that Conditional Use Permit 87-17 expires or is rescinded by
City Council at the request of the OWNER. CITY shall expunge this Covenant from
the record title of the PROPERTY.
If either party is required to(incur costs to enforce-the provisions of th,is
Cov\lnant, the prevai 1 in,9padY sh\il1 be entitled!O fu!,l'j;e,imbursement oJ all
costs, including reasonable attorneys' fees, from the~other p'arty. The CITY may
assign to persons impacted by the performance of this Covenant the r'ght to
