real property described in Exhibit A which is attached hereto and made a part
hereof and which is cOl1lTIon1y known as Assessor's Parcel Number 278-170-77 and
278-170-78.
WHEREAS, in lieu of the il1lTIediate installati.on and ded.ication of underground
uti 1 i ty improvements on the J)rciper.ty ,descri bed above., it is the de'si re and

nants for sa'id future improvements for the benef-i t of the City of Poway,
California.
The pwner. hereby declares that all the property described above is held and
shall be held,conveyed, hypothecated or encumbered', .leased, rented, used,
occupied and impr.oved, subject to the followin9 covenants, which shall run with
