("CITY" h!!rei nafterj-, OIt~ER hereby covenants and agre'es for the benefi t of the
CITY, to abide by conditions of the attached resol ution (Exhibit B).
Th-is Covenant s,hall ~unw;::th the land and be,tiinifing upon and inure to .the
benefit of the future owners, encumbrancers, successors, heirs, personal
representcitives~ transf~rees .and assigns of the respettive parties.
In the ,event 'that Minor CondifionalUse Permit~9-09 expires or is rescjnded
by' City Council ~t the request of the OWNER, CITY shall expunge this Covenant
from' the record title of' the PROPERTY.
If either party is re'quired to incur costs to enforce the provisions of this
Covenant, the p~evai1ing party ,shall be entitled to full reimbursement of aLl
costs, including 'reasonable attorneys' fees, from the other party. The CITY may
assign' to persons impacted by the perforinance of this Covenant the right to
enforce this Covenant against, OWNER.
