County January 11, 1989, Document No. 89-015161 and. as. owner and holder of the

ship to the CITY OF POWAY"it being understood and agreed that foreclosure.of
said Deed of Trust sha:1l not affect, defeat or render' ti1valid any rights -under
and by vi rtue of sa i d easement, and said easement sha 11 be paramount and
superior to the rights of any purchaser under a foreclosure of said Deed of
Trust.
