WHEREAS,
1. James and Jeri 'Lynn Gabrie.1, husband and wife, warrants that we are the
owners of the FE~ SiMPLE ESTATE ib and to th~ l.nd iIT the tity of Poway, State
of California, described in Exhibit "A" aITd .shown on plat map attached hereto
(i'The Subject Land"); which estate is or maybe subject to real estate taxes,
assessments, condit,ions, restrictions, and easement all as the same may be of
record, and
2. The GRANTOR grants to the City,
(A) A perpetua I easement for ,OPEN SPACE purposes over, upon, across, and
under the Subject Land, and no building, structure or other thing
whatsoever shall be constructed, erected, Rlaced, or maintained on the
Subject Land except for equestrian/pedestrian trai I improvements.
(B) Jhe perpet~al right, but not, the obligation to enter upon the Subject
LandaQ,d r\!move any bui ldings, structures, or other thi ngs ,whatsoever
constructed., erected, place'd, or mairita'.ined on the Subject Land
contrary to any term, covenant or condition of this easement except to
constru'ct, e'rect, place, and. maintain equestrian/pedestrian trai I
.improvements, and to do any ,work necessary to el imi nate the effects of
anyexcavatJon or placement of sand, soil, rock, or gravel or any
other material done or placed, on the Subject La'nd contrary to any
term, covenant, or conditions of this easem~nt except to do any work
for the maintenance of equestrian/pedestrian tr~il improvements.
3. GRANTOR covenants and agrees for himself and his successors and assigns as
follows:
(A)
Th?t he sha,ll not erect, construct, 'place"or ma.intai,n, or permit the
erection, construction, placement, or main'tena'nce of any building or
structure or other thing whatsoeve~ on the Subject Land other than
such buildings, structures, and other things as may be permitted pur-
suant to the' zoning ordinance of the'C~ty'ot Powaj.
(B)
That he shall not use the Subject Land for any purpose except as OPEN
SPACE purposes.
