WHEREAS, Development Review 89-31'and Variance 89-19 submitted by
Dominy~Ceci1 Associates, applicant, and Cirrus Development Group Inc, Owner,

impact on the environment and, hereby issues a Negative Declaration.

Variance 89-19
i, That there are 's'pecia1 ci rcumstances appHcab1e to the property, (s.ize,
shape, topography, location, or surroundings) or the intended use of
the property, and because of this, the strict application of the Zoning
Development Ordinance' deprives the property of privi leges enjoyed by
other properties in the vicinity under identical zoning classification.
The special circumstances include the 18 - 2D fo.ot grade separation
between the subj ect site and the adjacent res ident i a lly zoned property
and also the type of use and site plan configurat.ion on the adjacent
lot. The 25 foot setback i~question is intended ~o provide an ade~
quate buffer between residential and corrmercia1 land uses, In this

case, the grade differential and extsting parking lot will provide an
adequate separation between the two uses. In addition, although the
adjacent zoning is resident,ia1;' the land use is actually, corrm'ercia1 or
semi-public in nature as the property is developed with a congregate
care faci 1 ity, The strict application of the code would deny thi s
owner the right to develop in a manner similar to other CO zoned lots

2. That granting the variance or its modification is necessary for the
preservation and enjoyment of a substantial property right possessed by
other property in the same vi ci nity and zone and dented to the property
for which the variance is sought, in that the variance will allow the
lot to be developed in a manner similar to adjacent CO zoned property
'and there is no basis to require a full 25 foot side yard setback
because the adjoining land use is not residential and the additional
setback (over and above the ten feet requi red by'the CO zone) would
serve no "real, p,urpose,

the property or,improvements in such vicinUy and zone in which the
property is located' because the existing grade separation between the

The granting of this variance does not constitute a special privilege
inconsistent with the 1 imitations upon other properties in the vicinity
an~ zone in which such property is situated, because of the unique cir-
cumstances which exist on the lot and because adjacent CO zoned pro-
perty has been developed in a similar manner.
