COVENANT REGARDING REAL PROPERTY
Whereas, ,Gary Frankhauser and Richard Snow, PROPERTY OWNERS ("OWNER" hereinafter) are
the owners of. real property commonly known as AsseSsor's ParCEl Number 273'101-15, located at
17718 Vineyard Lane, Poway, CA ("PROPERTY hereinafter) and more fully described as:
LOT 15, OF CITY OF POWAY TRACT 88-11. IN,THEGITY OF POWAY, COUNTY OF SAN
DIEGO, STATE OF CALIFORNIA, ACCORDING TO MAP THEREOF NO. 12761, FILED IN
THE OFFICE OF THE COUNTY RECORDER OF SAN DIEGO, DECEMBER 28, 1990.
In consideration of the apRroval by the City of poway ("CITY" hereinafter) of Minor Development
Review (MORA) 00-123, involving a 580-square,foot attached guesthouse, OWNER hereby agrees
that no portion of'the guesthouse shall ever be rented or leased as a separate unit and kitchen facilities
shall never be installed,
This Covenant -shall run with the land and be binding upon and inure to the benefit of the future
owners, enoumbrances, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
In the event Minor Development Review Application 00-123 expires or is rescinded by the City
Council, and building permits areneverotltainedto construct thepi6posedai:lditibn, CITY shall at the
request of OWNER expunge this Covenantfrom the record title of the PROPERTY.
In the event of litigation to enforCE the provisions of this Covenant, the prevailing party shall be
entitled to full reimbursement of all costs, including reasonable attomeys' fees, 'from the other party.
