COVENANT REGARDING REAL PROPERTY
Whereas Mad 1 Poway, LLC, A California Limited Liability Company, Property Owner
("OWNER"hereinafter) of real property commonly known as Assessor'sParcel Number321-420-
01 ("PROPERTY" hereinafter), and more fully described as:
LOT 1 OF CITYOFPOWAY TRACT MAP 89-05, IN THE CITY OF POWA Y,
COUNTY OF SAN DIEGO, STATE OF CALIFORNIA, ACCORDING TO MAP
THEREOF NO. 14040, FILED IN THE OFFICE OF THE COUNTY RECORDER OF
SAN DIEGO COUNTY SEPTEMBER 20, 2000.
In consideration of the approval by the City of Poway ("CITY" hereinafter) of Minor
Development Review 00-106, involving construction of a, 5,928-square-foot single-family
residence as a condition ofTentative Tract Map 89-05, OWNER hereby agrees to the following:
1) Limitation of any future additions, guesthouse and/or structures to. one-story
elevation with a maximum building height of 22-feet, unless the building pad is
lowered (for every foot lowered the building height may be increased by one foot
up to a maximum of 35-feet).
2) Installation of a fire:sprinkler system is required in all structures with living space,
future additions, and guesthouse.
3) Restriction of removal of native vegetation in open space lot.
4) Maintenance of vegetation in accordance with the City of Poway's Wildland Fuel
Management Mitigation Plan for zones 2, 3, and 4.
5) Restriction of any permanent structures greater than 2-feet in height, other than
fences, walls, pools, and tennis courts within zone 4 of the Wildland Fuel
Management Mitigation Plan.
6) Restriction of any permanent structures including, but not limited to, fences, walls,
pools, and gazebos in zones 1 though 3 of the Wildland Fuel Management
Mitigation Plan.
7) No recreation court may be constructed anywhere on the parcel.

This Covenant shall run with theland and be binding upon and inure to the benefit ofthe
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event of litigation to enforce the provisions of this Covenant, the prevailing party
shali"be entitled to full reimbursement of all costs, including reasonable attorneys'fees, from the
other party,
