RESOLUTION NO. 09-016
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA
FINDING AND DETERMINING THE NECESSITY THAT
CERTAIN EASEMENTS BE ACQUIRED BY THE CITY UNDER
EMINENT DOMAIN PROCEEDINGS; DIRECTING THE
CITY ATTORNEY TO COMMENCE
A COURT ACTION FOR SAID PURPOSE

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1: That the City of Poway is authorized to acquire the easement interests
described in Exhibits A and B, and exercise the power of eminent domain for the public
purpose set forth herein in accordance with the California Constitution and California
Eminent Domain Law, Code of Civil Procedure Section 1230.010 et seq., and pursuant
to California Government Code Sections 37350.5 and 38730, and Code of Civil
Procedure Section 1240.010 et seq.
Section 2: That the public use for which the hereinafter described easements are
to be taken is the demolition of an outdated and substandard water purnpstation, and
the construction on the same site of a new water pump station entirely enclosed in a
permanent building, along with utilities and associated improvements, and rights of
ingress and egress across the easements for purposes of construction, reconstruction,
replacement, repair, maintenance, and use of the improvements on a portion of the
subject property. There is an urgent need to replace the existing pump station, as it
was built in 1956, it consists of outdoor equipment that is not enclosed in a building, its
pumps controllers and valves are at the end of their useful lives, the technology used to
control the motors is outdated, and the pump station is subject to failure at any time. A
new water pump station at this location is critical for ensuring that the City can continue
to meet water demand and have fire fighting capability in the High Valley area of Poway.
Section 3: That the general location and extent of the two easements to be taken
by said eminent domain proceedings is set forth in the description of said property
attached hereto as Exhibits A (Permanent Pump Station Easement) and B (Temporary
Construction Easement) by this reference incorporated herein, the same as if set out in
full. There is no other feasible location for the pump station project, due to the location
of the existing utilities that are connected to the pump station. The acquisition of the
proposed easements, and construction of the pump station, will not directly affect or
displace the single-family residence on the subject property.
Section 4 That the interests to be taken in said property are a permanent pump
station easement, and a temporary construction easement.
Section 5: That the offer required by Section 7267.2 of the Government Code
was made on March 30, 2009 to the property owners of record.

Section 6: That the Poway City Council finds, determines, and declares that:
(a) The public interest and necessity require said proposed project, for the
reasons stated in Section 2 above;
(b) Said proposed project is planned or located in the manner that will be most
compatible with the greatest public good and the least private injury;
(c) The property described in this resolution is necessary for said proposed
project;
(d) The offer required by Section 7267.2 of the Government Code has been
made to the owners of record; and
(e) The public interest and necessity require that the two easements on this site
be acquired, so that the City is able to demolish the existing water pump
station, and construct a new pump station entirely within a permanent
building. The greatest public good is achieved by the reconstruction of this
outdated water pump station with a new water pump station on the same site.
The permanent easement is necessary for the placement of a portion of the
new pump station, and the temporary construction easement is necessary for
access to the site for demolition and construction work on the pump station
project.
Section 7: That in accordance with the Code of Civil Procedure Section
1245.235, each person whose property is to be acquired by eminent domain and whose
name and address appears on the last equalized County assessment roll has been
given notice and a reasonable opportunity to appear and be heard on matters referred
to in Section 6 above
Section 8: That the City Attorney be and is hereby authorized and directed to
commence an action in the Superior Court of the State of California in and for the
County of San Diego in the name of and on behalf of the City of Poway against all
owners and claimants of the above-described property for the purpose of condemning
and acquiring said interest therein for the use of the City of Poway.
