the herei n descri bed right-of~way where requi red for the construction 'and mai ntenance
of said City Street. RESERVING unto GRANTOR of the above described parc'el of 1 and,
his successors or assi.gns, the right to eliminate such s,lopes and/or drainage structures
or portions thereof, when in the written opinion of the~ity Engineer of GRANTEE, the
necess ity therefore is removed by substituting other protection, support and/or
drainage facility, prov.ided such substitution is first approved in writing by said
Engineer,
The GRANTOR hereby further grants to GRANTEE all trees" gl'owths (growi ngor that may
,hereafter grow), and roadbu,il ding materials within said ri ght-of-way ,includingthe
right to take water, toge'ther with the right to use the same in such manner and at
