ABUTTER'S RIGHTS OF ACCESS 'APPURTENANT TO LOT "cn
IN AND TO DONART DRIVE,ANDA PORTION OF
DONART' DR-IVE, ALIi AS DEDICATED BY COUNTY
OF SAN DIEGO TRACT 1928, MAP NO. 4015

WHEREAS, the City Council of the City of poway desires
to summarily vatal!3, ceI:,tain street eqsements in accordance with
the procedures provfded thereof ,in Chapter 4, Part 3, Division 9
of the Streets and ,Highways Code' of the !State of California, com-
mencing at Sectfoh 8330; and
WHEREAS, Lot "c" designated "L,ot c: Res,erved for S,treet" and
Donart Drive,,-was ,c]edicated to the City o.fpoway by the approval"
an'd recordatfon~of County' of San'Diego 'Tract 1928, Map No. 4015,"
recorded November 19, 1958; and
WHEREAS, AbutteI:, ';s Rights of Acce~s Appurtenant to Lot "c"
in and to Dbnar't. Drive was similarly dedicated to the City of
poway per said Map No. 4015; and
WHEREAS;, upon, ihcorp9ration on December 1, 1980 the City of
poway became the' successor in interes't to the County of San Diego,
fOr the above' street ea,sement.
WHEREAS, a replacement easement in L6t20 of 'Belvedere
Estates Unit No.,: ,1, Map No. 4015 has been, irrevocably ofCfered for
dedication-to ,i:he' City of Pow'!y on November 19, 1986 as recorded
by the San Diego CoUnty Recorder ,as, FJP No. 86-532265; and
NOW,THEREFORE, BE,. IT RESOLVED, 'by the CIty Council of the
City of poway as follows: -
1., This summ'ary 'va,ca tion' \is liriade uI}der: the provisions
of 'Chapter 4, Part 3, Divi!sion 2. of the Streets and
Highway Gode of the state .oJ California.
2. The city Council hereby finds that:
A. The hereinbelow described street easement known
as ',tot "C" and a pOlOj:,ionof Donart Drive has been
impassable for vehicular traffic for a period of
fiv,e consecutive years (Section 8331a), thatn(J
pUblic money was expended for maintenance on the
street during such peri9d (Section 833lQ); and
that there are noin-plac,e public facilities that
are ~n USe ~nd would be .~ffected by the vacation
(Section 8'334.5),'
