A RESOLUTION OF THE CITY -COUNCIL
OF THECITY OF POWAY, CALIFORNIA,
ORDERING THE SUMMARY VACATION OF A PORTION OF YORK AVENUE
AND A.PORTION OF EDGEMOOR STREET
(Vacation No. 09-03)
WHEREAS, the City Council of the City of Poway desires to vacate a portion of
York Avenue and a portion of Edgemoor Street; in accordance with theprocedures
provided in Chapter 4, Part 3, Division 9 of the State of California Streets and Highways
Code; and
WHEREAS, portions of York Avenue and Edgemoor Street were dedicated for
public street purposes through the filing and recordation of an Irrevocable Offer of
Dedication on May 14, 1973, as file No. 73-129413.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Poway, California, as follows:
This vacation is made under the provisions of Section 8334 of Chapter 4, Part 3,
Division'9 of the State of California Streets arid Highways Code.
The .Cityi hereby findsthat the Irrevocable Offer ofDedication for a portion of York
Avenue and a portion of Edgemoor Street has not:been used for the purpose fore
Which it was dedicated for the past five years.
3. The City hereby declares that said portions of York Avenue and Edgemoor
Street, more particularly described in Exhibit "A" and depicted in Exhibit "B",
attached hereto, is hereby vacated.
The City Clerk of the City of Poway is hereby directed to cause a certified copy of
this Resolution to be recorded ih the office of the San Diego County Recorder.
That;from and after the date the Resolution is 'recorded, the vacation is complete.
